Posted in City Hall, the Library, the <br />Recreation Center, the Police and Courts Building and mailed to surrounding <br />property owners on May 21, 2010. <br />Conflict of Interest and Disclosure: <br />None heard. <br />Staff Report of Facts and Issues: <br />McCartney reviewed the application with the following discussion points: <br /> <br /> A special review use (SRU) request to create outdoor patio seating for the <br />LuckyPie Pizza Restaurant at 637 Front St. <br /> <br /> The eating area is proposed for the front of the building on the east facing <br />façade and would be approximately 1,548 square feet in area. <br /> <br /> The building was built in 1960 and purchased by the City of Louisville in <br />2008 and has remained vacant since its acquisition. <br /> <br /> The Pine Street access is to remain as an “in-only” one-way access. The <br />Front Street access can remain as a two-way access. <br /> <br /> The fenced area on the west side of the property and next to the alley will <br />be available for overflow parking, especially on Friday and Saturday <br />nights. <br /> <br /> The proposed patio would result in the removal of five (5) parking spaces <br />(including the handicapped space) that are currently located near the <br />entrance of the building. Removal of these spaces allows for 16 remaining <br />spaces (outside the fenced area). Therefore there is sufficient parking <br />remaining. <br /> <br /> A 3-foot high powder coated metal fence is proposed to be installed along <br />the perimeter of the patio. <br /> <br /> Landscaping will not change. <br /> <br /> Staff recommends the placement of potted planting areas to be placed <br />within the patio area. <br /> <br /> Downcast lighting throughout the patio area is proposed. <br /> <br /> Staff requires the lighting be turned off at 12 A.M. <br />McCartney continued with a review of the special review criteria. He stated the <br />application meets all five (5) criteria. <br />Staff recommends approval of Resolution No. 14, Series 2010 with the following <br />conditions: <br />1. Pine Street access shall remain as an “in-only” one-way access. <br /> <br />
