RESOLUTION NO. 1 <br />SERIES 2003 <br /> <br />A RESOLUTION APPROVING AMENDMENTS TO CONSERVATION <br />EASEMENTS OVER THE BOWES PARCEL 1 PROPERTY <br /> <br /> WHEREAS, the City of Louisville ("City") and the County of Boulder ("County") each <br />own an undivided interest in fee simple title to a 66-acre parcel of land referred to as the Bowes <br />Parcel 1 Property, which property is located generally at the southeast comer of the intersection <br />of Dillon Road and South 88th Street, and which property is more particularly described in <br />Exhibit A to the Amendments to Deeds of Conservation Easement in Gross which accompany <br />this Resolution (hereinafter the "Property"); and <br /> <br /> WHEREAS, the Property, which the City and County acquired in 2000, is subject to <br />reciprocal conservation easements from the City to County and the County to City recorded May <br />4, 2000 at Reception Nos. 2042508 and 2042509, Boulder County Records (the "Conservation <br />Easements"); and <br /> <br /> WHEREAS, the City and County have previously entered into a grant agreement ("Grant <br />Agreement") with the State Board of the Great Outdoors Colorado Trust Fund (the "Board") and <br />are to receive a grant from the Board to assist in funding the City and County's acquisition of the <br />Property; and <br /> <br /> WHEREAS, in furtherance of such grant from the Board, the City and County desire to <br />amend the Conservation Easements to incorporate certain provisions which are required by the <br />Board and which are intended to further preserve for scenic, open space, agricultural, passive <br />recreational and environmental uses, the natural condition and aesthetic and ecological features <br />of the Property. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The Proposed Amendments to Deeds of Conservation Easement in Gross between <br />the City of Louisville and the County of Boulder, for amendment of the existing Bowes Parcel 1 <br />Conservation Easements (the "Amendments") are hereby approved in essentially the same form as <br />the copies of such Amendments accompanying this Resolution. <br /> <br /> 2. The Mayor is authorized to execute the Amendments on behalf of the City, and the <br />Mayor is hereby further granted authority to negotiate and approve such revisions to said <br />Amendments as the Mayor determines are necessary or desirable for the protection of the City, so <br />long as the essential terms and conditions of the Amendments are not altered. The Mayor is hereby <br />fm~er granted authority to negotiate, approve and execute such amendments to the Grant <br />Agreement as may be necessary or required to facilitate the grant award fi.om the Board for funding <br />of the Bowes Parcel 1 acquisition, so long as the essential terms and conditions of the Grant <br />Agreement are not altered. <br /> 1 <br /> <br /> <br />
