<br /> fP5J@[%&u <br /> RESOLUTION NO. 38 <br /> SERIES 2005 <br />A RESOLUTION EST ABLISIDNG PHASING REQUlREl\fENTS ON RESIDENTIAL <br /> DEVELOPMENT APPLICA TJONS <br />\VHEREAS, the City of Louisville is a home rule municipal corporation organized under <br />and pursuam to Article XX of the Colorado Constitution and u1e Louisville Home Rule Charter; and <br />\VHEREAS, by virme of such authority. and as further authorized by state statutes, <br />including but not limited to C.R.S. ~S 29-20-101 et.llij. and 31-23-301 ~ ~., the City has broad <br />authority to plan for and regulate the use and development of land on [he basis of impact thereof on <br />the community and surrounding areas; and <br />WHEREAS, the orderly development of land in the City of Louisville is a benefit to <br />current and future residents; and, <br />WHEREAS, pursuant to such authorities, (he City has also adopted a Citywide <br />Comprehensive Plan, which Plan was adopted by City Council on August 16, 2005, by <br />Resolution No. 30, Series 2005, and which Plan serves as a guiding document containing a <br />community based vision and a policy framework under which new development and <br />redevelopment within the City 'will be evaluated; and, <br />\VHEREAS, the community based vision in the Citywide Comprehensive Plan states <br />that the City of Louisville will maintain a balanced, sustainable economic position in the <br />region; and <br />WHEREAS, the Comprehensive Plan further states that the City will maintain fiscal <br />balance through effective land use decisions that are consistent with the community's desire for <br />high quality services and amenities; and <br />WHEREAS, the Fiscal Impact Analysis prepared as part of the 2005 comprehensive <br />planning effort demonstrates that retail sales tax is a critical revenue generator for the City and <br />conversely, residential development significantly increases capital and operating expenses for <br />the City; and <br />'WHEREAS, the City of Louisville is conffilitted to maintaining a high level of <br />municipal services for both current and future residents of the City and ensuring that growth <br />and development are carefully planned in an orderly, fiscally responsible manner; and <br /> I <br />
