RESOLUTION NO. 31 SERIES 2010 A RESOLUTION APPROVING A SPECIAL REVIEW USE (SRU) TO ALLOW FOR THE OPERATION OF A PRIVATE ELEMENTARY SCHOOL ON A PROPERTY LOCATED AT 1436 MAIN STREET AND ZONED COMMERCIAL NEIGHBORHOOD (CN) WHEREAS, there has been submitted to the Louisville City Council an application for approval of a Special Review Use (SRU) to allow for the operation of a private elementary school on property located at 1436 Main Street and zoned Commercial Neighborhood (CN); and WHEREAS, the City Staff and the Planning Commission have reviewed the SRU application and found it, with conditions, to comply with Louisville zoning regulations, required general and specific design standards as set forth in Section 17.42.030 of the Louisville Municipal Code, the special review use criteria as set forth in Section 17.40.100 of the Louisville Municipal Code, and other applicable requirements; and WHEREAS, after a duly noticed public hearing on May 13, 2010, where evidence and testimony were entered into the record, including the findings in the Louisville Planning Commission Staff Report, dated May 13, 2010, the Planning Commission recommended approval of the SRU to the City Council, with conditions; and WHEREAS, City Council has reviewed the application and the recommendation of the Planning Commission and City Council finds that the SRU should be approved, subject to certain conditions; 1. The applicant shall develop a staggered start time schedule so there is no traffic conflict in the already established drop -off zone. 2. Patchwork Elementary staff shall use the existing off street parking on the subject property. 3. The maximum number of students at any one time shall not exceed 20 students. 4. The rear yard fencing shall be 6' in height and shall have a locked gate along the railroad right -of -way. 5. Trash recycling area shall be consistent with the regulations established in the Louisville Municipal Code. 6. Approval of this SRU is for the applicant only. For purposes hereof, applicant means the entity doing business as The Patchwork School and any affiliated entity under majority ownership and control of said applicant. NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Louisville, Colorado does hereby approve a Special Review Use (SRU) to allow for the operation of a private elementary school on property located at 1436 Main Street and zoned Commercial Neighborhood (CN), with the above conditions.
