RESOLUTION NO. 31 <br /> SERIES 2010 <br /> A RESOLUTION APPROVING A SPECIAL REVIEW USE (SRU) TO ALLOW FOR <br /> THE OPERATION OF A PRIVATE ELEMENTARY SCHOOL ON A PROPERTY <br /> LOCATED AT 1436 MAIN STREET AND ZONED COMMERCIAL NEIGHBORHOOD <br /> (CN) <br /> WHEREAS, there has been submitted to the Louisville City Council an <br /> application for approval of a Special Review Use (SRU) to allow for the operation of a <br /> private elementary school on property located at 1436 Main Street and zoned <br /> Commercial Neighborhood (CN); and <br /> WHEREAS, the City Staff and the Planning Commission have reviewed the <br /> SRU application and found it, with conditions, to comply with Louisville zoning <br /> regulations, required general and specific design standards as set forth in Section <br /> 17.42.030 of the Louisville Municipal Code, the special review use criteria as set forth <br /> in Section 17.40.100 of the Louisville Municipal Code, and other applicable <br /> requirements; and <br /> WHEREAS, after a duly noticed public hearing on May 13, 2010, where <br /> evidence and testimony were entered into the record, including the findings in the <br /> Louisville Planning Commission Staff Report, dated May 13, 2010, the Planning <br /> Commission recommended approval of the SRU to the City Council, with conditions; <br /> and <br /> WHEREAS, City Council has reviewed the application and the <br /> recommendation of the Planning Commission and City Council finds that the SRU <br /> should be approved, subject to certain conditions; <br /> 1. The applicant shall develop a staggered start time schedule so there is no <br /> traffic conflict in the already established drop -off zone. <br /> 2. Patchwork Elementary staff shall use the existing off street parking on the <br /> subject property. <br /> 3. The maximum number of students at any one time shall not exceed 20 <br /> students. <br /> 4. The rear yard fencing shall be 6' in height and shall have a locked gate along <br /> the railroad right -of -way. <br /> 5. Trash recycling area shall be consistent with the regulations established in the <br /> Louisville Municipal Code. <br /> 6. Approval of this SRU is for the applicant only. For purposes hereof, applicant <br /> means the entity doing business as The Patchwork School and any affiliated <br /> entity under majority ownership and control of said applicant. <br /> NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Louisville, <br /> Colorado does hereby approve a Special Review Use (SRU) to allow for the operation <br /> of a private elementary school on property located at 1436 Main Street and zoned <br /> Commercial Neighborhood (CN), with the above conditions. <br />
