RESOLUTION NO. 28 SERIES 2003 A RESOLUTION APPROVING THE WILLOW RANCH TDR AMENDMENT TO THE U.S. 36 CORRIDOR COMPREHENSIVE DEVELOPMENT ' PLAN INTERGOVERNMENTAL AGREEMENT AMONG THE CITY OF LOUISVILLE, THE CITY OF BOULDER, THE TOWN OF SUPERIOR AND THE COUNTY OF BOULDER, COLORADO. WHEREAS, the City of Louisville, the City of Boulder, the Town of Superior and the County of Boulder, Colorado are parties to the U.S. 36 Corridor Comprehensive Development Plan Intergovernmental Agreement, dated June 20, 2000, as amended by the First Amendment thereto dated April 9, 2002 (hereinafter the "Agreement"); and WHEREAS, the parties desire to amend the Agreement to allow the County of Boulder to proceed to consider the proposed Willow Ranch TDR NUPUD application, as further described in the proposed Willow Ranch TDR Amendment to the Agreement which attached hereto; and WHEREAS, the City is authorized to execute the proposed Willow Ranch TDR Amendment pursuant to C.R.S. ' 29-20-101 et sexb, which authorizes the parties to cooperate and contract with each other for the purpose of planning and regulating the development of land by means of a "comprehensive development plan"; and WHEREAS, pursuant to C.R.S. ' 29-20-105, the City Council has held a public hearing on the proposed Willow Ranch TDR Amendment after proper notice; and WHEREAS, the City Council finds that the proposed Willow Ranch TDR Amendment is in the best interests of the City and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The proposed Willow Ranch TDR Amendment to the U.S. 36 Corridor Comprehensive Development Plan Intergovernmental Agreement, as amended, a copy of which Willow Ranch TDR Amendment is attached hereto and incorporated herein by this reference, is hereby approved. 2. The Mayor is hereby authorized to execute the attached Willow Ranch TDR Amendment to the U.S. 36 Corridor Comprehensive Development Plan Intergovemmental Agreement, as amended, on behalf of the City Council of the City of Louisville, except that the Mayor is hereby further authorized to negotiate and approve such revisions to the Willow Ranch TDR Amendment as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of such Amendment are not altered.
