RESOLUTION NO. 28 <br /> SERIES 2003 <br /> <br />A RESOLUTION APPROVING THE WILLOW RANCH TDR <br />AMENDMENT TO THE U.S. 36 CORRIDOR COMPREHENSIVE <br />DEVELOPMENT ' PLAN INTERGOVERNMENTAL AGREEMENT <br />AMONG THE CITY OF LOUISVILLE, THE CITY OF BOULDER, THE <br />TOWN OF SUPERIOR AND THE COUNTY OF BOULDER, COLORADO. <br /> <br /> WHEREAS, the City of Louisville, the City of Boulder, the Town of Superior and the <br />County of Boulder, Colorado are parties to the U.S. 36 Corridor Comprehensive Development Plan <br />Intergovernmental Agreement, dated June 20, 2000, as amended by the First Amendment thereto <br />dated April 9, 2002 (hereinafter the "Agreement"); and <br /> <br /> WHEREAS, the parties desire to amend the Agreement to allow the County of Boulder to <br />proceed to consider the proposed Willow Ranch TDR NUPUD application, as further described in <br />the proposed Willow Ranch TDR Amendment to the Agreement which attached hereto; and <br /> <br /> WHEREAS, the City is authorized to execute the proposed Willow Ranch TDR <br />Amendment pursuant to C.R.S. ' 29-20-101 et sexb, which authorizes the parties to cooperate and <br />contract with each other for the purpose of planning and regulating the development of land by <br />means of a "comprehensive development plan"; and <br /> <br /> WHEREAS, pursuant to C.R.S. ' 29-20-105, the City Council has held a public hearing on <br />the proposed Willow Ranch TDR Amendment after proper notice; and <br /> <br /> WHEREAS, the City Council finds that the proposed Willow Ranch TDR Amendment is <br />in the best interests of the City and its citizens. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The proposed Willow Ranch TDR Amendment to the U.S. 36 Corridor <br />Comprehensive Development Plan Intergovernmental Agreement, as amended, a copy of which <br />Willow Ranch TDR Amendment is attached hereto and incorporated herein by this reference, is <br />hereby approved. <br /> <br /> 2. The Mayor is hereby authorized to execute the attached Willow Ranch TDR <br />Amendment to the U.S. 36 Corridor Comprehensive Development Plan Intergovemmental <br />Agreement, as amended, on behalf of the City Council of the City of Louisville, except that the <br />Mayor is hereby further authorized to negotiate and approve such revisions to the Willow Ranch <br />TDR Amendment as the Mayor determines are necessary or desirable for the protection of the City, <br />so long as the essential terms and conditions of such Amendment are not altered. <br /> <br /> <br />
