<br /> I" <br /> INITIATIVE ORDINANCE #917 <br /> AN ORDINANCE ADOPTING A NEW ARTICLE TO THE LOUISVILLE <br /> MUNICIPAL CODE TO CONTROL AND LIMIT THE SMOKING OF TOBACCO <br /> IN INDOOR PUBLIC PLACES. <br /> SECTION' 1. LEGISLATIVE INTENT <br /> In order to protect the public health, safety, comfort and <br /> general welfare, and because the s~oking of tobacco is a pOSitive <br /> danger to health, it is the declared purpose of this Article to <br /> prohibit smoking in areas which are used by or open to the public <br /> unless such ar~s are designated as smoking areas pursuant to <br /> this Article. <br /> . n <br /> - <br /> SECTION 2. DEFINITIONS <br /> (a) .S~oke- or .s.oking- .elns and includes the carrying of <br /> a lighted pipe. lighted cigar or lighted cigarette of any kind, <br /> or the ~ossession of any lighted cigarette. cigar. or pipe. <br /> (b .Co..on are.- .eans a lObby, hallway, elevator, <br /> restroom. or ~ther enclosed. indoor area where the public is <br /> likel! to gather in close proxi.tty. , <br /> c) .Public place. ~eans any enclosed area to which the <br /> public is invited or in which the pUblic is permitted, including, <br /> but not limited to, re~ail food production and marketing- <br /> establish.ents. restaurants, banks, co.~ercial establishments, <br /> theatres, waiting roo.s, reception areas. ~eeting rooms, educa- <br /> tional facilities. library, recreational facility, health care <br /> facilities. facilities providing live .usic or sporting events, <br /> and public transportltion facilities.' A private residence is not <br /> a .public place.M <br /> SECTION 3. PROHIBITIONS <br /> No person shall s.oke or carry any lighted smoking <br /> instrument in a public place. co..on area, or place where smoking <br /> is prohibited by this ordinance or the fire ~arshall, except in <br /> designated smoking areas as defined in Section 4. <br /> SECTION 4. PERMITTED SMOKING AREAS <br /> Smoking ~ay be per.itted in the fOllOWin? public plac~s: <br /> (a) Establish.ents in which ~alt. v nous or splrltous <br /> liquors are sold for consumption on the premises pursuant to a <br /> license except such establishments where more than twenty percent <br /> of the gross revenue during any period of time was from sales of <br /> food. (b) Retatl businesses pri.arily engaged in the sale of <br /> tobacco or tobacco products. <br /> .
