lwner, I, ( C ) The lessee, or principal manager aT a public place where slloking is permitted in the entire establ i shment shall post a sign using the words .Smoking PermittedM or the international slloking sYllbol conspicuously either on all public entrances or in a position clearly visible on entry into the public ~'ace. (d No-smoking signs shall be specifically placed in retail food production and lIarketing establishments, including grocery stores and superllarkets, so that they are clearly visible to persons upon entering the store, clearly visible to persons in checkout lines, and clearly visible to persons at meat and produce counters. SECTION 1. RE1PONSIBILITIES OF PROPRIETORS The owner, lessee, principal _anager, or person in charge of a public place or call_on. area shall'make reasonable efforts to obtain cOllpliance with this chapter in such places by: (a) Posting appropriate signs, as required by Section 6 heretn; (b) Asking smokers violating the intent of this ordinance to refratn frail slloking upon request of a client or ellployee suffering disco.fort frail the slloker; (c) Arranging seating and to provide a slloke-free area and affir.atively directing s.okers to designated smoking areas; (d) Using existing physical barriers and ventilation systems to lIinillize the toxic effect of slIoke in adjacent no- .- slloking areas; (e) Using any other lIeans which lIay be appropriate to further the inten~ of thts chapter. SECTION 8. ENFORCEMENT (a) The etty Adllinistrator or the City Adllinistrator's designee shall. be responsible for co.pliance with this article with regard to 'acilities which are.owned, operated, or leased by the Cit~ of Louisvill.. (b The owner, operator, lIanager, or ellployees of any facility, bustness or agency shall be required to orally inform persons violating this article of the provisions thereof. The duty to infor. such violator shall arise when such owner, operator, lIanager or employee of salle becolles aware of such violation, and shall be their sole enforcellent obligation hereunder. (c) Any citizen who desires to register a complaint under this article lIay initiate enforce.ent with the City Administrator or the City Ad.tnistrator's designee. (d) The City Adllinistrator or the City Administrator's designee may enforce the provisions of this article by either of the fOllowin, sections of (1 Serving notice requiring correction any violation of this article. (2) Requesttng the City Attorney to initiate approp- riate enforce.ent proceedtngs, including, without limi- tation, the initiation of a cOllplaint in municipal court or the institution of injunctive, abatement, or other appropriate action to prevent, enjoin, abate or re.ove such violation. 3
