RESOLUTION NO. 36 <br />SERIES 2003 <br /> <br />A RESOLUTION APPROVING AMENDMENTS TO CONSERVATION EASEMENTS <br />AND GRANTS OF EASEMENTS OVER THE WAREMBOURG PARCEL 1 PROPERTY <br />AND THE ADMOR EAST PARCEL PROPERTY IN CONNECTION WITH THE SOUTH <br />96TM STREET/DILLON ROAD IMPROVEMENTS PROJECT <br /> <br /> WHEREAS, the City of Louisville ("City") and the County of Boulder ("County") each <br />own a 50% undivided interest in fee simple title to two parcels of land commonly referred to as <br />the Warembourg Property Parcel 1 and the Admor East Parcel, which parcels are located, <br />respectively, at the northwest and southwest comers of the intersection of Dillon Road and South <br />96TM Street, and are hereinafter referred to collectively as "the Parcels"; and <br /> <br /> WHEREAS, the purchase agreements and conservation easements for the Parcels <br />provide that right-of-way necessary for the improvement of South 96th Street and Dillon Road <br />will be dedicated from the Parcels and that, as part of such dedication, such right-of-way will be <br />released from the conservation easements affecting the Parcels; <br /> <br /> WHEREAS, the City and County have identified the necessary right-of-way to be <br />dedicated from the Parcels for the improvement of South 96th Street and Dillon Road, which <br />right-of-way is to be released from the conservation easements affecting the Parcels; and <br /> <br /> WHEREAS, the City and County has also identified certain storm sewer easements to be <br />granted in connection with such improvement project; and <br /> <br /> WHEREAS, for such purposes, there have been proposed three Amendments to Deeds of <br />Conservation Easement in Gross and two Storm Sewer Easements, and such instruments have <br />been executed by the County; and <br /> <br /> WHEREAS, the City by this resolution desires to approve the Amendments to Deeds of <br />Conservation Easement in Gross and the Storm Sewer Easements and authorize other action in <br />relation thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The Proposed Amendments to Deeds of Conservation Easement in Gross between <br />the City of Louisville and the County of Boulder, for amendment of the existing Warembourg <br />Parcel 1 Conservation Easements and the existing Admor East Parcel Conservation Easements (the <br />"Amendments") are hereby approved in essentially the same form as the copies of such <br />Amendments accompanying this Resolution. <br /> <br /> <br />
