ORDINANCE NO. 1400 <br />SERIES 2002 <br />AN ORDINANCE AMENDING SECTION 17.56.070 OF THE LOUISVILLE MUNICIPAL <br />CODE TO ADOPT AN UPDATED FLOOD INSURANCE RATE MAP FOR THE CITY <br />OF LOUISVILLE <br />WHEREAS, the City has been advised by the Federal Emergency Management Agency <br />(FEMA) that the City's floodplain regulations must be amended to adopt FEMA's updated flood <br />insurance study and flood insurance rate map for the City; and <br />WHEREAS, the City by this ordinance desires to adopt such updated study and map and <br />amend its floodplain regulations accordingly. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. Section 17.56.070 of the Louisville Municipal Code is hereby amended to <br />read as follows (words added are underlined; words deleted are stricken through): <br />Sec. 17.56.070 Establishment of official maps. <br />The location and boundaries of areas within the flood regulatory district <br />are identified by the Federal Emergency Management Agency in a scientific and <br />engineering report entitled "The Flood Insurance Study for Louisville," dated <br />October 4, 2002Jane 2, 1995, with an accompanying flood insurance rate map <br />(FIRM). as adopted and amended from time to time, which is hereby adopted by <br />reference and declared to be a part of this chapter. Copies of the official map are <br />kept on file with the director of public works, the planning department and the <br />city clerk. The boundary lines on the map shall be determined by the use of the <br />scale appearing on the map. Where there is a conflict between the boundary lines <br />illustrated on the map and actual field conditions, the dispute shall be settled <br />according to section 17.56.190. <br />Section 2. A copy of the flood insurance study and FIRM map dated October 4, 2002, <br />that is adopted by this ordinance and incorporated into the Louisville Municipal Code shall be filed <br />with the permanent ordinances of the City. <br />Section 3. All other ordinances or portions thereof inconsistent or in conflict with this <br />ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. <br />Section 4. The repeal or modification of any provision of the Municipal Code of the <br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole <br />or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred <br />under such provision, and each provision shall be treated and held as still remaining in force for the <br />
