Any property within the City which is zoned agricultural or land which is actively used for grazing or crop production shall be exempt from the requirements of th is Section, unless it is adjacent to property which is not zoned agricultural, or is adjacent to property zoned agricultural which has a use not entirely for agricultural, commercial crop, animal production or as a horse stable. In such even t , it shall be the duty of the owner, agent, or occupant of said property to cut the weeds as required under this Section within a distance of 100 feet from the adjacent propertyline. In addition, the requirements of this Section shall not apply to any wildlife preserve or wildlife area designated by the City. 8.08.030 Owner Liable For Cost of Cutting Weeds by City. If weeds exist on any property to -heights greaterthan--six- inches, the Director of Community Services or his authorized agent, no less than ten days after notice by mail to the last known address of the owner, agent, or occupant of the property, may order the cutting and removal of the weeds by the City. The City shall assess the costs therefore, plus an additional amount up to fifty dollars to cover administrative costs, against the lots or tracts of land from which the weeds are removed. In the event that said owner, agent or occupant cannot be contacted under this Section, his address is unknown or a mailed notice is returned undelivered, the Director of Community Services may post said property wi th a notice giving said property owner, agent or occupant five days to cut the weeds. =tL INTRODUCED, READ AND ORDERED PUBLISHED this 1 day of '-fY( fU-f' , 1985. ~#~ Mayor ATTEST: ~~t~~ City Clerk.
