RESOLUTION NO. 42 <br />SERIES 2003 <br /> <br /> A RESOLUTION APPROVING AN <br /> AMENDED FINAL PUD DEVELOPMENT PLAN FOR <br />THE CHRISTOPHER PLAZA APARTMENTS PUD - PERMITTING THE <br />CONSTRUCTION OF 13 STORAGE UNITS AND 16 GARAGE UNITS - 1015 S. <br /> BOULDER ROAD <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request <br />for approval of an amended final PUD development plan'for the Christopher Plaza <br />Apartment PUD that would permit the construction of 13 storage units and 16 garage <br />units to be constructed for the apartment complex; and, <br /> <br /> WHEREAS, all materials related to the amended f'mal PUD development plan <br />have been reviewed by City Staff and the Planning Commission and found, with <br />conditions, to generally be in compliance with the sprit and intent of the City's zoning <br />ordinance, the CDDSG and the provisions of the Louisville Plaza Planned Unit <br />Development (PUD) Plan; and, <br /> <br /> WHEREAS, after a duly noticed public hearing, where evidence and testimony <br />were entered into the record, including the findings in the Louisville Planning <br />Commission Staff Report of 13 November, 2003, the Planning Commission <br />recommended approval to the City Council; and, <br /> <br /> WHEREAS, City Council has reviewed the application, including the requested <br />changes to the Christopher Village Apartment PUD and the CDDSG and finds those <br />requests to be justified as documented in the public record for the 13 November 2003 <br />Planning Commission public hearing; and further f'mds that said final PUD development <br />plan should be approved and amended with the conditions approved by the Planning <br />Commission that include: <br /> <br />1. The applicant shall include five (5) new 2.5 inch caliper ornamental trees within <br /> Outlot A. <br />2. Site lighting for the storage facilities and garage buildings shall only be <br /> illuminated to a maximum of one (1) foot candle and the fixtures shall be <br /> installed that shields and directs the light source "down" on the site. <br />3. The storage units and garage units approved, shall be rented to the apartment <br /> dwellers of the Christopher Village Apartments only." <br /> <br /> <br />
