.L ORDINANCE NO. 1(.;,.3 ,;n ORDINArIC:: CREAT=~;G SPECL\L I~lPR()VEl!E~'n D~~- ~.~ TRICT NO. 1985-1, IN THE CITY OF LOUISVI LLE, COLORADO: ORDERING THE CONSTRUCTION AND INSTALLATION THEREIN OF CERTAIN IHPROVEHENTS; ADOPTING DETAILS AND SPECIFICATIONS THEREFOR; PROVIDING FOR THE ISSUANCE OF BONDS IN PAYHENT FOR SAID IMPROVEr1ENTS: PROVIDING FOR OTHER DETAI LS IN CONNECTION ~'J IT H THE DISTRICT: AND DECLARING AN Er1ERGENCY. WHEREAS, pursuant to and in accordance with Section 31- 25-503, C. R. S. , there has been s ubmi t ted to the City Council (the "Council") of the City of Louisville, Colorado ( the "City"), a petition for improvements and for the creation of a special improvement district ( the "Petition") : and WHEREAS, the peti t ion was signed by one hundred percen t (l 0 0% ) of the property owners to be assessed (j:..~. , the sing 1 e petitioner), and contained a request that the City wa i v e the notice, publication, and hearing provided for in Sect ion 31-25- 503, C.R.S. : and HHEREAS, the peti tioner has also offered to enter into an agreement with the City concern i ng the proposed district, the improvements, the spec ial assessment bonds to be issued, and other matters; and ~'JHEREAS , the City finds that the peti tion is in accor- dance with law and hereby determines that it should enter into such agreement, that a special improvement district should be created, that the improvements peti tioned for should be constructed, installed, and acquired in the manner set forth in the Pe tit ion, and that the City should waive the notice, publication, and hearing provided for in Section 31-25-503, C.R.S.: and WHEREAS, pursuant to an o rd e r of the Council, the engineer for the proposed spec i al improvement project has prepared and filed preliminary pI ans, specifications, estimates of cost, maps, and schedules for the proposed improvements: and - 2 -
