<br /> .. <br /> ORDINANCE NO. 875 <br /> AN ORDINANCE AMENDING SECTION <br /> 6.12.020 CONCERNING "VICIOUS <br /> DOGS" CONTAINED IN THE <br /> LOUISVILLE MUNICIPAL CODE. <br /> WHEREAS, the City Council has determined that the <br />current Section 6.12.020 "Vicious Dog" contained in the <br />Louisville Municipal Code is outdated; and, <br /> WHEREAS, the City Council has determined that a need <br />exists to update and expand the definition of "vicious dog" to <br />include other animals and include specific defenses in the <br />ordinance. <br /> NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO, as follows: <br /> Section 1. Section 6.12.020 of the Louisville Municipal <br /> - <br />Code is hereby repealed. <br /> Section 2. The following section is added to Chapter <br /> - <br />6.12, Title 6, of the Louisville Municipal Code: <br /> 6.12.020 <br /> Vicious Animals <br /> A. It shall be unlawful for any owner, possessor, or <br />person who keeps any vicious animal to permit the same to be or <br />run at large. It shall be the duty of the code enforcement <br />officer and his assistants to take up and impound any such <br />animal that is found running at large. <br /> B. For purposes of this section, a "vicious animal" is <br />any animal that bites, claws, or attempts to bite or claw any <br />person, or bites another animal, whether or not the attack is <br />consummated or capable of being consummated. <br /> C. It is a specific defense to the charge of owning or <br />keeping a vicious animal if: <br /> 1. The animal was acting in self defense or in defense <br />of its young. <br /> 2 . The person attacked or bitten was engaging in con- <br />duct reasonably calculated to provoke the animal to attack or <br />bite. <br /> 3 . The person attacked or bitten was unlawfully engag- <br />ing in entry into or upon a fenced or enclosed portion of the <br />premises upon which the animal was lawfully kept or upon a por- <br />tion of the premises where the animal was lawfully chained. <br />
