ORDINANCE NO. it'D AN ORDINANCE CREATING SPECIAL IMPROVEMENT DIS- TRICT NO. 1985-1, IN THE CITY OF LOUISVILLE, COLORADO; ORDERING THE CONSTRUCTION AND INSTALLATION THEREIN OF CERTAIN IMPROVEMENTS; ADOPTING DETAILS AND SPECIFICATIONS THEREFOR; PROVIDING FOR THE ISSUANCE OF BO NDS IN PAYMENT FOR SAID IMPROVEMENTS; PROVIDING FOR OTHER DETAI LS IN CONNECTION WITH THE DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, pur suant to and in accordance with Section 31- 25-503, C.R.S. , there has been submitted to the City Council (the "Council") of the Ci ty of Louisville, Colorado (the "City"), a petition for improvemen ts and for the creation of a specia I improvement district ( the "Petition") ; and WHEREAS, the Petition was signed by one hundred percen t (100%) of the property owners to be assessed (1.. ~. , the sing Ie petitioner), and contained a request that the City waive the notice, publication, and hearing pr ovided for in Section 31- 25- 503, C.R.S.; and vvH EREAS , the petitioner has also offered to enter into an agreement with the City concerning the pr oposed district, the impr oveme nts, the special assessment bonds to be issued, and other matters; and WHEREAS, the Ci ty finds that the Peti tion is in accor- dance with law and hereby determines that it should enter into such agr eeme nt, that a spe ci al impr oveme n t district should be created, that the improvements petitioned for should be cons truc ted, ins tal led , and acquired in the manner set forth in the Petition, and that the City should wa i ve the notice, publication, and hearing provided for in Section 31-25-503, C.R.S.; and WHEREAS, pursuant to an order of the Council, the engineer for the pr opos ed special improvement project has prepared and filed preliminary pI a ns, s pe c i f i cat ion s , estimates of cos t, maps, and schedules for the proposed improvements; and - 2 -
