<br /> ORDINANCE NO. it'D <br /> AN ORDINANCE CREATING SPECIAL IMPROVEMENT DIS- <br /> TRICT NO. 1985-1, IN THE CITY OF LOUISVILLE, <br /> COLORADO; ORDERING THE CONSTRUCTION AND <br /> INSTALLATION THEREIN OF CERTAIN IMPROVEMENTS; <br /> ADOPTING DETAILS AND SPECIFICATIONS THEREFOR; <br /> PROVIDING FOR THE ISSUANCE OF BO NDS IN PAYMENT <br /> FOR SAID IMPROVEMENTS; PROVIDING FOR OTHER <br /> DETAI LS IN CONNECTION WITH THE DISTRICT; AND <br /> DECLARING AN EMERGENCY. <br /> WHEREAS, pur suant to and in accordance with Section 31- <br /> 25-503, C.R.S. , there has been submitted to the City Council (the <br /> "Council") of the Ci ty of Louisville, Colorado (the "City"), a <br /> petition for improvemen ts and for the creation of a specia I <br /> improvement district ( the "Petition") ; and <br /> WHEREAS, the Petition was signed by one hundred percen t <br /> (100%) of the property owners to be assessed (1.. ~. , the sing Ie <br /> petitioner), and contained a request that the City waive the <br /> notice, publication, and hearing pr ovided for in Section 31- 25- <br /> 503, C.R.S.; and <br /> vvH EREAS , the petitioner has also offered to enter into <br /> an agreement with the City concerning the pr oposed district, the <br /> impr oveme nts, the special assessment bonds to be issued, and other <br /> matters; and <br /> WHEREAS, the Ci ty finds that the Peti tion is in accor- <br /> dance with law and hereby determines that it should enter into <br /> such agr eeme nt, that a spe ci al impr oveme n t district should be <br /> created, that the improvements petitioned for should be <br /> cons truc ted, ins tal led , and acquired in the manner set forth in <br /> the Petition, and that the City should wa i ve the notice, <br /> publication, and hearing provided for in Section 31-25-503, <br /> C.R.S.; and <br /> WHEREAS, pursuant to an order of the Council, the <br /> engineer for the pr opos ed special improvement project has prepared <br /> and filed preliminary pI a ns, s pe c i f i cat ion s , estimates of cos t, <br /> maps, and schedules for the proposed improvements; and <br /> - 2 - <br />
