EXAMPLE: Since the decision on a special use permit request must be made <br />based on the evidence presented at a hearing, an e-mail sent to a Planning <br />Commissioner or Council member about that request should be made a part <br />of the record and available for review, so that interested parties can review it. <br />EXAMPLE: The same e -mail can also be considered an ex- parte—or off - <br />the- record contact — regarding the special use request, so the decision maker <br />should disclose that he or she has received e-mails regarding the request and <br />state that they have been made part of the record. <br />B The Posting Requirement. <br />Under the Open Meetings Law, posting of notice 24 hours in advance of the meeting is <br />considered full and timely public notice. However, under the City Charter, notice of each <br />regular and special meeting of City Council, except an emergency special meeting, must be <br />posted 48 hours in advance. What meetings must be posted: <br />• 1. Regular City Council meetings. <br />2. Special City Council meetings. <br />3. Meetings of the City Council's standing committees. (e.g., finance committee, water <br />committee; etc.). <br />4. Task Forces. Task forces are advisory bodies formally constituted by action of the <br />City Council (see Charter Section 10 -2(f). <br />5. Meetings convened by other entities? Yes, if public business is discussed and four or <br />more City Council members are in attendance or expected to be in attendance. In the <br />recent case of Costilla County Conservancy Dist. v. Bd. of County Comm'rs of <br />Costilla County, 64 P.3d 900 (Colo. App. 2002), the Court of Appeals concluded that <br />"public notice is required not only when the public body has called or arranged the <br />meeting, but also when a quorum of that body is present or expected to be present at <br />a meeting called or arranged by others." (In the case, all three county commissioners <br />were invited to a meeting arranged by the state. Two commissioners attended but <br />made no presentations, did not participate in the discussions, and did not ask <br />questions. Others in attendance did make presentations about a mine in the county.) <br />The Colorado Supreme Court has taken an appeal of this case. The result of Costilla <br />is that there should be methods for determining and providing notice of rion- social <br />meetings which four or more Council members are expected to attend. <br />Social Event?
