He felt it will bring many <br /> benefits to the City of Louisville and provide eco- friendly buildings. He explained if <br /> ConocoPhillips is allowed to build 95' buildings, it would reduce the size and the look of <br /> the outdoor parking lots, by providing underground parking. <br /> COUNCIL COMMENTS <br /> Councilor Muckle asked if all the conditions requested by the Planning Commission <br /> have been met. Principal Planner McCartney confirmed all the conditions were met. <br /> Councilor Muckle voiced his support for the Open Space Advisory Board's <br /> recommendations for the quallity of the public land dedication. <br /> Councilor Dalton commented on Resolution No. 12, Series 2010, Section 1(g), which <br /> requires LEED's certification and requested the requirement be stricken. <br /> Mayor Sisk requested Resolution No. 12, Series 2010, Section 1(h), which stipulates <br /> Staff will work with ConocoPhillips to mitigate negative impacts to Paradise Lane, also <br /> be stricken. He explained the Northwest Parkway Agreement already mitigates <br /> negative impacts to Paradise Lane. He felt a basis for waivers on building heights has <br /> been established and noted building height waivers should not be confused with vested <br /> property rights. <br /> PUBLIC COMMENTS <br /> Richard Lopez, 4450 Arapahoe, Boulder, CO Attorney representing the property owners <br /> of 9350 Paradise Lane, explained his clients will be impacted by the ConocoPhillips <br /> development. They are one of the two remaining property owners who will have some <br /> collateral effects of this development. He was encouraged with the recommendation for <br /> ConocoPhillips to work with the property owners to mitigate the negative impacts. He <br /> objected to the removal of the clause. <br /> COUNCIL COMMENTS <br /> Councilor Muckle asked if ConocoPhillips had any problem working with the Paradise <br /> Lane property owners by establishing creative landscaping berms. Mary Manning, <br /> ConocoPhillips General Manager for Corporate Real Estate explained the landscaping <br /> for the subject property will address any negative impact to the Paradise Lane <br /> properties. She opposed the language in Section 1(h) and felt it singles out <br /> ConocoPhillips in a relationship which has already been established. <br /> Mayor Sisk closed the public hearings on Resolutions No. 10, 11, and 12, Series 2010, <br /> and Ordinance No. 1568 and Ordinance No. 1569, Series 2010. <br />
