The view from the residential <br />areas is to be screened with slide-in-slats. <br />. One access point to the site just north of the intersection of Cannon Street and Lafayette <br />Street. <br />. Hours of operation are to be 8 AM to 5 PM seven days a week. <br />. No on-site lighting. <br />. No on-site structures for the site. <br />. No on-site dump station. <br />. The applicant letter states that the request is for an interim use but does not clarify the <br />term of the use. <br />. A letter from Scott Deborski dates April 24, 2006 reflects that the duration of use is for a <br />five-year approval with opportunity for extensions in two-year increments. <br />. The primary discussion point of this application is the need to clarify the duration of the <br />interim use, and determine if the City would seek to enter into an agreement with the <br />property owner which would waive certain public improvement obligations and design <br />standards in exchange for the establishment of an enforceable time limit for the use. <br />. The applicant is requesting relief from the provisions of the IDDSG which sets standards <br />for the amount of outside storage, the name in which it is screened, and the requirement <br />to pave the storage area with asphalt or concrete. <br />. Referral comments received resulted in three additional requirements: <br />1) The Public Works Department is requesting additional information for grading <br />and drainage information. Specifically, a request for a grading plan and a drainage <br />plan which conforms to the City of Louisville Storm Drainage Criteria Manual is <br />request. As the property is greater than one acre in area, overlot grading will <br />require erosion control and a storm water management permit/plan. <br />2) The Louisville Fire Protection District is requesting a second access point to the <br />storage area on Cannon Street. The width of the drive aisle within the storage yard <br />will require a minimum with of20' and meet required turning radius requirements <br />for emergency vehicles. <br />3) A minimum of two additional fire hydrants will need to be installed on Cannon <br />Street, as well as one hydrant on site to provide the required fire protection for the <br />proposed use. <br />. Staff requests direction from the Planning Commission as to whether it would support the <br />use of additional staff and attorney resources to draft an agreement which would be <br />between the City and the property owners. The provisions of an agreement would waive <br />certain public improvement obligations and design standards in exchanged for the <br />establishment of an enforceable time limit for the proposed use. The agreement would <br />need to specify clear remedies as to the enforceability of the agreement. <br />. Staff has communicated to the applicant that without such an agreement or other <br />mechanism which enforces a limited duration of the use, that staff would not support the <br />degree of relief being requested from the required design standards. <br />. Staff recommends continuance of this application to allow staff the time to draft such use <br />agreement and have it reviewed by the property owner, and / or draft a resolution of <br />support with conditions, or draft a resolution of disapproval. <br /> <br />Commission Questions of Staff: <br />Loo asked if this is the first time that the City has requested to develop a use agreement. <br />
