<br />Planning Commission <br />Meeting Minutes <br />May 11 , 2006 <br />Page 9 of 12 <br /> <br />Pritchard expressed concerns with granting the requested number of reliefs. He supports the <br />additional time of staff and the City's attorney to develop the necessary agreement for the <br />temporary use of the property. <br /> <br />Loo questioned if the Commission would be willing to support other temporary uses in this area <br />as well other areas that are undeveloped in Louisville. <br /> <br />Pritchard stated that the temporary use is appropriate in this area since redevelopment had not <br />begun. <br /> <br />Lipton expressed concern with the 5-year term, a 6-foot screening for existing residential <br />neighbors is not enough and the current condition of Cannon Street and not wanting to put <br />demands of the City for street improvements to Cannon Street just for this particular use. He <br />requested that language regarding those improvements be a part of the agreement. <br /> <br />Lipton requested final comments and summary from each Commissioner. <br /> <br />McAvinew now supports the project but would request additional fence requirements along the <br />residential sections of the property and the length of the term of the agreement should be <br />shortened with renewals. <br /> <br />Pritchard requested a shorter term for the agreement, a renewable clause and wording to protect <br />the Applicant from premature street improvements. <br /> <br />Hartman supports the shorter term of the agreement. <br /> <br />Dalton suggested that the term be for three-years with a 2-year renewable term that is easy for all <br />parties, perhaps an Administrative Approval for the City's interest. <br /> <br />Lipton summarized with the following points for staff to use for the development of the <br />agreement and the continuation of the application: <br />. Three-year original term length <br />. Multiple two-year administrative approval renewal <br />. No demands of the City for street improvements just for this project. <br />. Privacy fencing adjacent to the residential areas to be reviewed by the Commission. <br />. The inclusion of the original three conditions. <br /> <br />Planning Commission agreed those were the points of discussion and direction for the staff and <br />the applicant. <br /> <br />Lipton moved and Pritchard seconded a motion directing the staff to work with the City Attorney <br />and the applicant to develop the agreement and to come back to the Commission when those <br />items are completed. <br /> <br />Motion passed by voice vote. <br /> <br />~ Resolution No. 20, Series 2006, Amendment to HWY 42 Revitalization Area <br />Comprehensive Plan - proposed amendment regarding transportation and access <br />plan - public hearing. <br />.
