Deputy City Manager Balser explained during the ConocoPhillips hearing process, City Staff negotiated with Boulder County, Lafayette and Broomfield staff regarding a potential amendment to the Northwest Parkway IGA to address the proposed extension of Campus Drive. Staff presented a draft amendment to City Council for their review, comment and potential approval of Resolution No. 35, Series 2010. The IGA is scheduled to be considered by Lafayette on June 15, by Broomfield on June 22 and by Boulder County on June 29th. Highlights of the proposed amendment are as follows: Paragraph 1 amends the IGA map to change the designation of all Paradise Lane parcels from Rural Preservation to City Preservation. Paragraph 2(a) acknowledges that the parcels are currently unincorporated Rural Preservation and provides that the City may annex the parcels; upon annexation, the Parcels are designated City Preservation, with uses as summarized below. Paragraph 2(b) addresses the 20 acres owned by ConocoPhillips and located south of Paradise Lane and adjacent to 96th Street. Future uses are limited to right -of -way uses, agriculture, and open space as defined in the amendment. Paragraph 2(c) addresses the remaining 30 acres owned by COP. Future uses are limited to right -of -way uses, agriculture and low density residential development, as defined in the amendment. Clustering is provided for on parcel 2 at a total of 6 units and no residential units are permitted on Parcel 3. Paragraph 2(d) addresses the three parcels not owned by COP. The provisions of the amendment carry forward for these parcels the same density provisions as the current IGA, and add reference to clustering and right -of -way uses. Paragraph 3 the current IGA grants consent to County's use of eminent domain to acquire City Preservation parcels. This amendment removes that consent. Mayor Sisk explained the IGA amendment process began six months ago and represents a four -way agreement. Paradise Lane is located in Boulder County and ConocoPhillips has been working with those property owners. The Lafayette City Council decided not to consider the agreement because it does not address Jefferson County Parkway issues. Mayor Sisk noted Jefferson County Parkway issues are not a part of the IGA. Broomfield County requests a combination resolution, which addresses the Jefferson County Parkway interests and road access. At a recent DRCOG meeting Louisville voted no on the Jefferson County Parkway interests due to concerns about arterial roadway impacts in Louisville. He stressed the importance of the IGA as it is the entrance to the ConocoPhillips Campus.
