and reenacted, to provide for the following adoptions, modifications, or deletions to the Model <br /> Traffic Code adopted by this ordinance, to read as follows: <br /> Sec. 10.04.020. Additions or modifications. <br /> Unless specifically noted as an amendment to Appendix I, Definitions, the <br /> following additions, amendments and deletions are made to the specified sections <br /> of Parts 1 -19 of the Model Traffic Code: <br /> A. Section 114, Removal of traffic hazards, subsection (1) is amended to read as <br /> follows: <br /> (1) Local authorities may by written notice require the <br /> owner of real property abutting on the right -of -way of any <br /> highway, sidewalk, or other public way to trim or remove, at the <br /> expense of said property owner, any tree limb or any shrub, vine, <br /> hedge, or other plant which projects beyond the property line of <br /> such owner onto or over the public right -of -way and thereby <br /> obstructs the view of traffic, obscures any traffic control device, or <br /> otherwise constitutes a hazard to drivers or pedestrians. <br /> B. Section 116, Restrictions for minor drivers definitions, subsection (3) is amended <br /> to read as follows: <br /> (3) A violation of this section is a traffic infraction, and, <br /> upon conviction, the violator may be punished as follows: <br /> (a) By the imposition of community service and/or a fine; <br /> (b) By the levying of a fine of not more than 100 dollars for <br /> a first offense, a fine of not more than 200 dollars for a second <br /> offense, and a fine of not more than 300 dollars for any subsequent <br /> offense. <br /> (c) By the assessment of two license suspension points <br /> pursuant to section 42 -2- 127(5) (kk), C.R.S. <br /> C. Section 225, Mufflers prevention of noise, subsection (3) is amended to read as <br /> follows: <br /> (3) Any person who violates subsection (1) of this section <br /> commits a class B traffic infraction. <br /> Ordinance No. 1579, Series 2010 <br /> Page 2 of 9 <br />
