<br />Board of Adjustment <br />Meeting Minutes <br />January 18, 2006 <br />Page 2 of 7 <br /> <br />Board Member Verification of site visits. ex parte contacts and conflicts of interest: <br />Cordell requested Board Member Verification for the variance request at 1200 Lincoln Ave. <br />Weise stated that he visited the site, had no conflict and disclosed the he owns property in the <br />Old Town area approximately two blocks from this location. <br /> <br />All other members (Cordell, Malmquist and Loeblich) stated they had visited the site, had no <br />conflict and no contacts. <br /> <br />~ Case No. 05-035-V A: 1200 Lincoln Ave., Lots 85 and 86, Block 4, Nicolas Di Giacomo <br />Addition: Keith and Shirley Helart: a variance request to construct a new detached garage at <br />the eastern edge of the lot, adjacent to the alley requiring three variances from the Louisville <br />Municipal Code Chapter 17 and the Old Town Overlay Zoning District: <br />1) Reduce the minimum street side setback from 10 feet to 6 feet. <br />2) Increase the maximum lot coverage from 2,250 SF to approximately 2,575 SF <br />(approximately 325 SF). <br />3) Allow encroachment into the vision clearance area. <br /> <br />Public Notice Verification: <br />Schwertfeger verified the public notice requirements: published in the Daily Camera; posted in <br />City Hall, the Public Library, the Recreation Center and the Courts and Police Building; mailed <br />to surrounding property owners within 500 feet of the subject property; and the property was <br />posted with the required signage. Loeblich moved and Weise seconded a motion to accept the <br />Public Notice Verification information as presented by Staff. Motion passed by voice vote. <br /> <br />Stat! Presentation of Facts and Issues: <br />Johnstone provided the following summary: <br />. Property is located at 1400 Lincoln in the Nicolas Di Giacomo Addition. <br />. The existing home is approximately 1,540 SF and was built in 1960. Keith and Shirley <br />Helart are the existing owners and also built the home in 1960. <br />. The existing home was built prior to zoning being enacted in Louisville. <br />. The property is controlled by the RL zoning designation and is also within the Old Town <br />Residential Overlay Zoning District, which was adopted by the City in 1996. The Old <br />Town Overlay establishes most of the setback, lot coverage and similar requirements. <br />. The existing home complies with some but not all zoning requirements. The home is 3.5 <br />feet off the north property line - 5 feet would be required by the Old Town Overlay. The <br />covered patio at the rear of the home is setback 20 feet from the alley and should be 25 <br />feet. These structures are considered "legally non-conforming" and can certainly be kept <br />and maintained. <br />. The property does not currently have a garage, which is what the property owners are <br />requesting through this variance application. <br />. Based on the location of the existing structures, the only realistic location for a garage is <br />at the rear of the property, adjacent to the alley. The property owners have requested <br />approval of a 480 SF garage adjacent to the alley and accessed off of Caledonia Street. <br />. As proposed, the garage would require variances from 3 zoning requirements: <br />1. Reduction in street side yard setback from 10 feet to 6 feet. <br />2. Increase in maximum lot coverage from 2,250 SF to 2,575 SF <br />
