draft rules or adopted rules of the Department of Revenue, and develop and implement any <br />appropriate regulations or pursue exercise of a local option consistent with state law; and <br />WHEREAS, City Council fords and determines that acceptance and processing of <br />applications or requests for business registration, sales tax licenses, building permits, and certificates <br />of occupancy for medical marijuana dispensaries and commencing any operation of a medical <br />marijuana dispensary within the City pending completion of the above - listed review may undermine <br />and defeat the City's ability to promote and protect the public health, safety, and welfare; and <br />WHEREAS, City Council finds and determines that it is necessary and appropriate to <br />extend the temporary moratorium on accepting, processing, or issuance of applications or requests <br />for business registration, sales tax licenses, building permits, and certificates of occupancy for <br />medical marijuana dispensaries until March 31, 2011; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The foregoing recitals are hereby affirmed and incorporated herein by this <br />reference as findings of the City Council. <br />Section 2. Section 2 of Ordinance No. 1561, Series 2009, as amended by Section 1 of <br />Ordinance No. 1570, Series 2010, is hereby further amended to delete the phrase "August 15, 2010" <br />and insert "March 31, 2011" in its place. <br />Section 3. Section 4 of Ordinance No. 1561, Series 2009, as amended by Section 2 of <br />Ordinance No. 1570, Series 2010, is hereby further amended to delete the phrase "August 15, 2010" <br />and insert "March 31, 2011" in its place. <br />Section 4. The moratorium established by Ordinance No. 1561, Series 2009 and <br />extended by Ordinance No. 1570, Series 2010 and this ordinance applies without limitation to <br />medical marijuana dispensaries as defined in Ordinance No. 1561, Series 2009 and to medical <br />marijuana centers, optional premises cultivation premises, and medical marijuana - infused <br />products manufacturers as defined in H.B. 10 -1284. <br />Section 5. City Staff is hereby directed to study, develop, review and evaluate <br />appropriate recommendations and regulations pertaining to medical marijuana dispensaries for <br />presentation to and consideration by City Council, to include evaluation of the effect of H.B. 10- <br />1284 and any related rules and regulations upon the City's authority to license dispensaries and <br />regulate the operation of and the use of land for dispensaries. <br />Section 6. The provisions of this ordinance are temporary in nature and may be <br />repealed by a subsequent legislative enactment, including a repeal to correspond to the effective <br />date of the Department of Revenue regulations. The temporary moratorium established by this <br />ordinance shall terminate as of March 31, 2011 unless sooner repealed <br />2 <br />8 <br />
