EXECUTIVE SESSION — PENDING LITIGATION <br />(Louisville Charter, Section 5 -2(d) — Authorized Topics — <br />"Consultation with an attorney representing the City with respect to <br />pending litigation" and C.R.S. Section 24 -6- 402(4) (b) <br />REGULAR BUSINESS ITEMS SUSPENDED <br />City Attorney Light requested the City Council Convene an Executive Session for the <br />purpose of consultation with respect to the following pending litigation: a) Sewer back- <br />up claim and b) Software vendor contract dispute. <br />City Clerk Varra read Section 2.90.050 — Public Statement of the Louisville Municipal <br />Code, which governs the topic that may be discussed in an executive session. <br />City Attorney Light cited Section 5 -2 (d) Authorized Topics, of the Louisville Charter, <br />"Consultation with an attorney representing the City with respect to pending litigation" <br />and the Colorado Open Meeting Law, C.R.S. Section 24 -6- 402(4) (b)) which permits <br />executive sessions. <br />MOTION: Mayor Sisk moved the City Council convene an executive session for the <br />purpose of discussion on pending litigation, and requested City Attorney Light, City <br />Manager Fleming and Finance Director Watson be included in executive session <br />regarding the software vendor contract dispute and City Attorney Light and City <br />Manager Fleming be included in the sewer back -up claim. Councilor Dalton seconded <br />the motion. All were in favor. The City Council left the meeting room at 9:05 p.m. <br />The City Council returned to the meeting room at 9:50 p.m. <br />REGULAR BUSINESS ITEMS CONTINUED <br />REPORT — DISCUSSION /DIRECTION /ACTION — Pending Litigation <br />City Attorney Light explained Council met in executive session for the purpose of <br />consultation with an attorney with respect to pending litigation. In executive session, the <br />City Council discussed two matters, 1) Software vendor contract dispute, 2) Sewer <br />back -up claim, which are not currently in litigation, but could be litigated.
