<br />Board of Adjustment <br />Meeting Minutes <br />March 15, 2006 <br />Page 2 of 3 <br /> <br />Discussion / Direction - <br /> <br />~ Alternate (Associate) Member Ordinance - An Ordinance that would amend the <br />Louisville Municipal Zoning Code to permit an Alternate (Associate) Member <br />appointment to the Board of Adjustment. <br /> <br />Johnstone reviewed the draft ordinance with the following information: <br /> <br />. The City Council has appointed an Associate Member (Wayne Chancellor) pending <br />adoption of an ordinance that would amend the Louisville Municipal Code (LMC) to <br />create this additional member of the BOA. <br />. BOA action is not formally required on this ordinance; however, staff feels it appropriate <br />to receive any informal input the Board might have as the ordinance will directly affect <br />the composition and activities of the BOA. <br />. Section 17.48.030 of the LMC would create an Associate Member to the Board. If all <br />regular members are present the associate member would not participate in discussions <br />and deliberations on public hearing application matter. <br />. Section 17.48.040 of the LMC would create a vice-chair position with the BOA and <br />would change the current use of 'chairman' to the gender neutral 'chair'. <br />. Section 17.48.070 would change the use of 'acting chairman' to 'vice-chair'. <br />. Section 17.48.110 would clarify the public notice requirements for BOA variance <br />applications as follows: <br />1) Publication of a public notice at least 10 days prior to the meeting in a newspaper <br />of general circulation <br />2) Posting of the property 10 days prior to the meeting. <br />3) Mailing notice to property owners within 500 feet of the property requesting the <br />vanance. <br /> <br />The Board discussed the draft ordinance and indicated support for the concept of having an <br />associate member. There was consensus that having an additional member would provide a <br />better service to applicants requesting variances in situations where not all regular members of <br />the Board are able to attend the hearing. <br /> <br />Malmquist requested clarification that the associate member would not participate in public <br />hearings when all regular members were present. It was clarified that the associate member <br />would only vote on public hearing items if one or more members of the Board were absent. <br /> <br />Stuart moved and Loeblich seconded a motion to recommend approval of the ordinance to the <br />Planning Commission with no changes.
