Building Code Board of Appeals <br />Minutes <br />5.18.23 <br />Page 3 of 8 <br />(i) Hearing and deciding appeals of orders, decisions, or determinations <br />made by building officials relative to the application of the building <br />code; <br />(ii) Hearing and deciding licensee or registration suspensions or revocations <br />relative to violations of the building code, refusal to obey orders issued <br />under the code, or neglecting to pay any fee assessed under the <br />building code; and <br />(iii) Advising City Council on matters related to the building code as <br />requested. " <br />The Board discussed the quasi-judicial hearings that the BCBOA has heard in <br />the past and the decisions that were made from those hearings. <br />Berry re -iterated that 99.9% of BCBOA time is spent on building code adoption <br />and changes. Berry suggested changing the title of the Board to emphasize what <br />they do for the majority of their meeting time. <br />Burgener added that it could stress more of the advisory piece, as an advisory <br />board to City Council. <br />Berry explained that the building official receives a packet for the BCBOA to <br />comment on and it is introduced at the next meeting of the BCBOA. Berry didn't <br />recommend changing the role of the board. <br />Mason asked if that part of the decision should include what the board <br />recommends in their decision. <br />Berry explained that the BCBOA board cannot force City Council to use their <br />recommendation. <br />Burgener explained that the director of Community Development, Rob Zuccarc <br />supported the idea that the BCBOA could offer more advice and explanation on <br />building code adoption and changes. <br />Dino explained that the board should be consulted for their expert opinion on <br />building code decisions. <br />Berry interjected that Council person Dickenson did not know that the current <br />year of the code is the year that the code should be adopted by a building dept. <br />Board Member Peter Geise joined the meeting. Berry caught up Geise on what <br />has already been discussed, specifically regarding the role of the BCBOA board <br />and that Rob Zuccaro was under the impression that the BCBOA was not an <br />advisory board, however, it is stated in the bylaws that they do have an advisory <br />role as requested by City Council. <br />5 <br />
