ILI City of Louisville <br />Planning Department <br />November 22, 1993 <br />Ms. Susan Griffiths, City Attorney <br />Griffiths & Tanoue <br />1860 Blake Street, #550 <br />Denver, CO 80202 <br />RE: Variance for 1201 Grant Street <br />On September 16, 1993 the Board of Adjustment heard a variance request from Peter Stewart <br />to build a two story addition to an existing single family residence at 1201 Grant Street. The <br />record of that meeting including application, petitioner's justification, site plans, staff report, <br />Public Hearing notice and minutes is attached. The record clearly reflects that the applicant <br />intended to add on to the existing non -conforming structure. This is reflected in the Public <br />Hearing notice, the applicant's site plan, letter of justification and presentation to the Board of <br />Adjustment as reflected in the minutes. Nowhere in the record does the applicant indicate any <br />intent to demolish the existing structure. Based upon the evidence presented at the hearing, the <br />Board of Adjustment granted the requested variance without conditions. <br />A building permit was issued based upon the variance granted by the Board of Adjustment. <br />Subsequently the applicant completely demolished the existing structure except for the <br />foundation. The Building Department issued a stop work order because the scope of work being <br />done exceeded the scope of the variance and building permit. The demolition of the existing <br />structure eliminated the nonconforming status of the structure under Section 17.36.060.
