LOUISVILLE BOARD OF ADJUSTMENT <br />STAFF REPORT <br />DECEMBER 21, 1994 <br />APPLICANT: Ramon and Carole Griffin <br />OWNER: same <br />LOCATION: 555 Orchard Drive - Lot 24, The Meadows at Coal Creek <br />ZONING: RE - Residential Estate with an approved PUD Development Plan <br />REQUEST: Variance to allow a 16.55 foot front yard setback where a minimum 20 feet <br />is required by The Meadows at Coal Creek PUD. <br />BACKGROUND <br />The Meadows at Coal Creek PUD and final plat were approved by the City in September, 1992. <br />The subject property was platted as Lot 24, The Meadows at Coal Creek Subdivision, which was <br />recorded in February, 1993. Lot 24, is rectangular in shape and is 65 feet wide and 115 feet <br />deep. The Meadows at Coal Creek PUD specifies the following minimum building setbacks: <br />front yard - 20', side yard - 5', and rear yard - 25'. The original underlying RE zone district <br />setbacks are: front yard - 30', side yard - 10', and rear yard - 25'. <br />A building permit for Lot 24 was approved June 6, 1994 and issued to Environmental Systems <br />Design. Bob Parich was listed as the supervisor for the job. The site plan approved with the <br />building permit application showed a 20.0' minimum front yard setback, a 27.0' rear yard setback <br />and minimum side yard setbacks of 10.0' and 7.5' (See Exhibit 1). All setbacks shown were in <br />conformance with the PUD. <br />An improvement location certificate prepared by Allen L. Royer and dated 7/13/94 was submitted <br />to the City. The improvement location certificate showed a dwelling under construction on Lot <br />24 with a front yard setback of 16.9' from the property line. No rear yard setback was shown. <br />This improvement location certificate was reviewed by Peter Kernkamp of the Louisville Planning <br />Department and marked in red ink "NOT APPROVED min. 20' required. PK 8/31/94." (See <br />Exhibit 2.) A second improvement location certificate was submitted to the Building Inspection <br />Department that was a revision of the first that showed a 21.9' distance between the dwelling <br />under construction and a line connecting two points labeled nail/disc offset 5' from the property <br />line (See Exhibit 3). Also a rear yard setback of 25.1' is shown although the distance scales to <br />approximately 30' and the dimensions 25.1' + 68' + 16.9' = 110'. This revised improvement <br />1 <br />
