We have planned a rather extensive remodel of our kitchen and the addition of a <br />second floor bedroom. In the course of applying for a building permit we learned that our house <br />as constructed is not in conformity with set -back requirements. I understand that our house, <br />which was built in approximately 1908 is located five feet from the north property line rather <br />than the currently required seven feet from the line. <br />Our plan does not involve any reduction of the existing set -back distance. Instead, we <br />intend to rebuild the existing wall in its existing location. The remodel does call for extending <br />the structure an additional two feet to the east by cantilevering off the existing foundation. We <br />believe that the proposed remodeling is the minimal variance that will provide relief, since it <br />does not create a larger intrusion into the set -back than already exists. Any increase in the set- <br />back distance would result in an unacceptable decrease in floor space. The building is currently <br />less than 1,000 square feet in size. Obviously it would be completely impractical to consider <br />moving the foundation on which the entire building rests. And, without moving the entire <br />building, bringing the rear part of the north side of the building in conformity with the ordinance <br />would result in an odd looking, smaller building which would still appear from the street to be <br />in the same location. The portion of the building effected by the remodeling is about 26 feet <br />long. If it is rebuilt in its current location there will be approximately 54 square feet of land <br />area effected within the set -back at issue. <br />
