LOUISVILLE BOARD OF ADJUSTMENT <br />STAFF REPORT <br />JUNE 16, 1993 <br />APPLICANT: James H. and Dianne E. Leach <br />OWNER: same <br />LOCATION: 725 LaFarge Avenue <br />ZONING: R-L Residential Low Density <br />REQUEST: Variances to allow 2' and 3' side yard setbacks <br />where 5' is required and 54.3% lot coverage where a <br />maximum of 30% is permitted to construct a detached <br />garage. <br />BACKGROUND <br />The subject property is a non -conforming lot measuring 25' x 125' <br />(3125 square feet). There is an existing 21'3" x 55'5" (1177 <br />square feet - 37.7%) one story single family dwelling on the <br />property. The request is to construct a two car detached garage <br />adjacent to the alley at the rear of the property. The proposed <br />garage is 20' wide by 26 feet deep (520 square feet - 16.6%). The <br />proposed side yard setbacks are 3'0" from the north property line <br />and 2'0" from the south property line. The total lot coverage with <br />the proposed garage is 1697 square feet or 54.3 percent of the lot <br />area. The maximum lot coverage permitted in the R-L zone district <br />is 30 percent. <br />VARIANCE CRITERIA <br />The Board of Adjustment has authority to hear and decide, grant or <br />deny this application for a variance to section 17.12.040 pursuant <br />to the powers granted the Board in section 17.48.110 of the <br />Louisville Municipal Code. The Board may grant a variance only if <br />it makes findings that all of the criteria, as established under <br />section 17.48.110, have been satisfied insofar as applicable: <br />1. That there are unique physical circumstances or conditions <br />such as irregularity, narrowness or shallowness of lot, or <br />exceptional topographical or other physical conditions <br />peculiar to the affected property. The staff finds that this <br />criterion is met. The existing non conforming lot of record <br />is only 25 feet wide compared to the 70 feet minimum lot <br />width required in the R-L zone district. <br />1 <br />
