January 16, 1995 <br />To: Board of Adjustment <br />From: Will & Carol Gabonay, 109 Lois Cir., Louisville, Co., 80027 <br />Subject: Request variance on a portion of a setback. <br />Our request for a variance on a portion of a setback on one side of <br />our residence located at 109 Lois Cir., is for the purpose of <br />building a sunroom/porch addition. This addition will fall within <br />a portion of the setback. This letter is written in order to <br />address the requirements under Title 17 of the Louisville Municipal <br />Code. Listed are those requirements and our response to them. <br />Requirement #1 <br />That there are unique physical circumstances or conditions such as <br />irregularity, narrowness or shallowness of lot, or exceptional <br />topographical or other physical conditions peculiar to the affected <br />property. <br />Response: <br />The lot is narrow on both sides, the front is an impractical <br />consideration (to be addressed), and the back is shallow. The <br />back, however, is the most appropriate location for the proposed <br />addition. The reasons supporting this location are the following: <br />1) This side offers unobstructed views to the south and west, as <br />well as the most sun. <br />2) Easy access to the sunroom with existing entry doors currently <br />servicing the deck from the kitchen area. This location <br />"flows" well with the existing floor plan. <br />3) Would not obstruct a neighbors view or aesthetically mar the <br />neighborhood. <br />4) Would be a simple design to compliment the house. <br />5) Would only require a variance on a portion of the setback on <br />the back (west) side of the house, ie., A 10 ft. setback for <br />approximately 17 Lft. in length of the 73 ft. total length, or <br />a variance on about 12% of the back yard (the back yard <br />requires a 20 ft. setback, this uses up all of the back yard). <br />Requirement #2 <br />That the unusual circumstances or conditions do not exist <br />throughout the neighborhood or district in which the property is <br />located. <br />Response: <br />This condition is unique to our property. The size of our house <br />and the way the house is situated on the lot limits the choices <br />available for an addition and creates a unique situation. Houses <br />that have been added onto have had larger lots so variances were <br />not needed, ie., 148 Lincoln Cir., 417 Lincoln Cir., and 249 Lois <br />Dr. <br />
