LOUISVILLE BOARD OF ADJUSTMENT <br />STAFF REPORT <br />JANUARY 18, 1995 <br />APPLICANT: Gary Dunlap <br />OWNER: same <br />LOCATION: 741 Lincoln Avenue (Southwest corner of Lincoln Avenue and <br />Spruce Street) <br />ZONING: RL - Residential Low Density <br />REQUEST: Approval of a variance to allow an accessory building height of 24 <br />feet where 20 feet is permitted for construction of a detached two <br />car garage. <br />BACKGROUND <br />At its October 19, 1994 meeting, the board of adjustment heard and approved an 18 foot <br />street side yard setback where 25 feet is required and a 5 foot rear yard setback where 10 <br />feet is required for construction of a detached two car garage on this property. At that <br />hearing the applicant did not present building elevations for the proposed garage. When <br />he submitted for a building permit to build the garage, the plans showed a building height <br />of 24 feet. The maximum building height permitted for an accessory structure is 20 feet. <br />The subject property consists of Lots 1,2,3 and 4, less the south 10' of Lot 4, Block 9 <br />Pleasant Hill Addition. The property dimensions are 114.5' deep by 100' wide for a total <br />lot area of 11,450 square feet. The existing brick two story residence is setback 10.8 feet <br />from the Spruce Street property line. At the rear of the property is a platted alley, <br />however, it is used for an irrigation ditch and does not provide any vehicular access to any <br />adjacent properties. The existing residence has a steep pitched roof line. <br />The proposal is to build a detached two car garage measuring 22' wide by 26'8" deep. <br />The approved rear yard setback from the platted alley is 5 feet and the approved street side <br />yard setback from the Spruce Street right of way is 18 feet. Access to the garage will be <br />a driveway from Spruce Street. The applicant is proposing to duplicate the steep pitched <br />roof line of the existing residence on the proposed garage and include a dormer for a small <br />office over the garage. <br />1 <br />
