The property is <br />subject a maximum lot coverage of 20% (2,726 s.f.) under the RE <br />zoning standards. <br />The applicant has indicated that the variance is needed to <br />successfully tie the improvements together which, according to the <br />applicant, is the preference of the ACC. <br />The proposed building plans meet all setbacks and standards of the <br />RE zone district. <br />STAFF RECOMMENDATION: <br />Staff recommends approval of the lot coverage variance for the <br />following reasons: <br />1. The Board has jurisdiction to grant a lot coverage variance. <br />2. There are unique physical circumstances peculiar to the <br />affected property. Existing site improvements include an open <br />foundation and partially finished, double car, detached <br />garage. The foundation and garage were abandoned in August <br />of 1990 and constitute a public nuisance. <br />3. The physical circumstance is unique to this property and does <br />not exist throughout the neighborhood. <br />4. Due to the physical circumstance the property cannot be <br />reasonably developed in conformity with the provisions of the <br />title. The code defined front yard setback is on Evans <br />Circle. <br />The existing garage can only meet the required front setback <br />of 30 feet if it is attached. The front yard setback <br />requirement for a detached garage is 40 feet. <br />5. That such unnecessary hardship has not been created by the <br />applicant. <br />6. The variance, if granted, will not alter the essential <br />character of the neighborhood or district in which the <br />property is located. The City of Louisville has taken action <br />on the existing site improvements as a public nuisance. The <br />ACC objects to the negative exposure created by the detached, <br />freestanding nature of the existing garage which is further <br />aggravated by the corner lot location. <br />7. The variance, if granted, is a minimum variance that will <br />afford relief and is the least modification possible of the <br />provisions of the title. <br />2 <br />
