RESOLUTION NO. 30 <br />SERIES 1999 <br /> <br />A RESOLUTION APPROVING A PURCHASE AGREEMENT TO BUY <br />AND SELL VACANT REAL ESTATE AND CONSERVATION EASEMENT <br /> <br /> WHEREAS, the City of Louisville is the owner of certain real property consisting of <br />33.738 acres located adjacent to Dillon Road approximately one-third of a mile west of the <br />intersection of Dillon Road and South 96th Street, which property is known as the "Admor West <br />Parcel" and is more particularly described in the Purchase Agreement attached hereto; and <br /> <br /> WHEREAS, an agreement has been proposed between the City of Louisville and the <br />County of Boulder under which the County would purchase from the City a fifty percent undivided <br />fee interest in the Admor West Parcel, including a fifty percent interest in the development rights <br />for the Admor West Parcel, for a purchase price of three hundred and seventy-five thousand dollars <br />($375,000.00); and <br /> <br /> WHEREAS, under such agreement, the Admor West Parcel would be held and used jointly <br />by the City and County as open space, and the City and County would grant reciprocal conservation <br />easements over the Admor West Parcel pursuant to C.R.S. section 38-30.5-101 et seq., for the <br />purposes of preserving and protecting for scenic, open space, agricultural, passive recreational and <br />environmental uses, the natural condition and aesthetic and ecological features of the Admor West <br />Parcel; and <br /> <br /> WHEREAS, the City Council has determined it is in the best interest of the City and its <br />citizens to sell and convey to the County such fifty percent undivided fee interest in the Admor <br />West Parcel, and to exchange with the County reciprocal conservation easements over the Admor <br />West Parcel. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The proposed Purchase Agreement to Buy and Sell Vacant Real Estate and <br />Conservation Easement between the City of Louisville and the County of Boulder, a copy of which <br />is attached hereto and incorporated herein by this reference, is hereby approved. <br /> <br /> 2. The Mayor is hereby authorized to execute the attached Purchase Agreement on <br />behalf of the City Council of the City of Louisville, except that the Mayor is hereby granted the <br />authority to negotiate and approve such revisions to said Purchase Agreement as the Mayor <br />determines are necessary or desirable for the protection of the City, so long as the essential terms <br />and conditions of the Purchase Agreement are not altered. <br /> <br />3. The Mayor, City Administrator and City Staff are further authorized to do all things <br /> <br /> <br />
