RESOLUTION NO. 63 <br />SERIES 1999 <br /> <br /> A RESOLUTION APPROVING <br />A FINAL PUD DEVELOPMENT PLAN FOR <br />TEXACO EXPRESS LUBE ON LOT 4, <br />LOUISVILLE PLAZA, FILING TWO <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a Final PUD Development Plan for Lot 4, Louisville Plaza, Filing Two; and <br /> <br /> WHEREAS, all materials related to the Final PUD Development Plan have been reviewed <br />by City Staff and the Planning Commission and found, with conditions, to be in compliance with <br />the Louisville zoning ordinances, related policies and previous approvals; and <br /> <br /> WHEREAS, after a properly advertised public hearing concerning said Final PUD <br />Development Plan, the Planning Commission recommended approval to the City Council, with <br />conditions; and <br /> <br /> WHEREAS, the applicant has revised the application in response to most of the <br />Planning Commission's conditions and City Council finds that said Final PUD Development <br />Plan should be approved, with the following conditions: <br /> <br />1. That no Certificates of Occupancy shall be issued until construction acceptance has been <br /> granted for Hecla Way. <br /> <br />2. That the applicant shall dedicate an access easement for the revised detention pond access <br /> prior to issuance of any Certificates of Occupancy. <br /> <br />3. The PUD landscape plan shall be revised to substitute a different type of evergreen for the <br /> Austrian Pines located in the landscape island at the northwest corner of the building. <br /> <br />4. Applicant and owner, South Boulder Road Corporation, shall be jointly and severely <br /> responsible for the construction of Hecla Way. <br /> <br />5. The PUD landscape plan shall be revised to provide greater screening of the parking lot <br /> from Hecla Way. <br /> <br /> NOW THEREFORE, BE IT RESOLVED, that subject to the above stated conditions~ <br />the City Council of the City of Louisville, Colorado does hereby approve a Final PUD <br />Development Plan for Lot 4, Louisville Plaza, Filing Two. <br /> <br /> <br />
