RESOLUTION NO. 63 SERIES 1999 A RESOLUTION APPROVING A FINAL PUD DEVELOPMENT PLAN FOR TEXACO EXPRESS LUBE ON LOT 4, LOUISVILLE PLAZA, FILING TWO WHEREAS, there has been submitted to the Louisville City Council, a request for approval of a Final PUD Development Plan for Lot 4, Louisville Plaza, Filing Two; and WHEREAS, all materials related to the Final PUD Development Plan have been reviewed by City Staff and the Planning Commission and found, with conditions, to be in compliance with the Louisville zoning ordinances, related policies and previous approvals; and WHEREAS, after a properly advertised public hearing concerning said Final PUD Development Plan, the Planning Commission recommended approval to the City Council, with conditions; and WHEREAS, the applicant has revised the application in response to most of the Planning Commission's conditions and City Council finds that said Final PUD Development Plan should be approved, with the following conditions: 1. That no Certificates of Occupancy shall be issued until construction acceptance has been granted for Hecla Way. 2. That the applicant shall dedicate an access easement for the revised detention pond access prior to issuance of any Certificates of Occupancy. 3. The PUD landscape plan shall be revised to substitute a different type of evergreen for the Austrian Pines located in the landscape island at the northwest corner of the building. 4. Applicant and owner, South Boulder Road Corporation, shall be jointly and severely responsible for the construction of Hecla Way. 5. The PUD landscape plan shall be revised to provide greater screening of the parking lot from Hecla Way. NOW THEREFORE, BE IT RESOLVED, that subject to the above stated conditions~ the City Council of the City of Louisville, Colorado does hereby approve a Final PUD Development Plan for Lot 4, Louisville Plaza, Filing Two.
