City Council <br /> Meeting Minutes <br /> November 16, 2010 <br /> Page 7 of 11 <br /> Councilor Clabots said he had heard from citizens on both sides of the issue and spoke <br /> in favor of option number three and regulating the operations. <br /> Mayor Sisk polled the Council members.— Mayor Sisk, Councilor Yarnell, Councilor <br /> Clabots, and Mayor Pro Tem Marsella favored option #3. Councilor Dalton, Councilor <br /> Muckle and Councilor Sackett favored a ban. <br /> Mayor Sisk stated Council direction with the 4 -3 vote would be to proceed with MMOs <br /> with restrictions. <br /> Deputy City Manager Balser said she had comments from earlier discussions and <br /> welcomed any more. <br /> Mayor Pro Tem Marsella wanted to limit the cultivation, the number of plants and the <br /> number of operations, whether by distance regulations or however possible. <br /> Mayor Sisk asked for staff to look at the 1500 ft. buffer and the Ft. Collins ordinance. <br /> He wanted to look at a broad range of application fees. <br /> DISCUSSION /DIRECTION /ACTION APPROVAL OF 2011 LEGISLATIVE AGENDA <br /> Mayor Sisk requested a Staff presentation. <br /> Deputy City Manager Balser highlighted the following 2011 Legislative issues of interest <br /> to the City which will be included in the pamphlet distributed to the Boulder County <br /> legislators at the breakfast scheduled for December 3: <br /> Tax Policy the City opposes efforts to diminish local authority in this area. <br /> The City opposes State- granted exemptions that erode municipal revenue <br /> sources. The City is interested in results of the State tax structure study. <br /> Home Rule there is a need to change the Medical Marijuana Code to allow <br /> local authority for criminal background checks. <br /> Exemption from responsibility of medical costs for prisoners with pre- existing <br /> conditions support legislation extending exemption to municipalities that <br /> counties enjoy. <br /> Issuance of Special Events Permits- Give local licensing sole authority to <br /> approve or deny and increase days allowed to 15 from 10. <br /> Energy and Environment Support the development of legislation providing <br /> standards and other options for increasing the overall level of recycling in <br /> Colorado. <br /> Planning and Land Use remain the same as in previous years. <br /> Councilors discussed the legislative issues and suggested the Special Events Permits <br /> days could be expanded. Mayor Sisk wanted a clear message of no unfunded <br /> mandates. <br />
