RESOLUTION NO. 35 <br /> SERIES 2010 <br /> A RESOLUTION APPROVING THE CAMPUS DRIVE AMENDMENT TO SOUTHEAST <br /> BOULDER COUNTY, SOUTH 96 STREET, DILLON ROAD AND US 287 AREA <br /> COMPREHENSIVE DEVELOPMENT PLAN INTERGOVERNMENTAL AGREEMENT <br /> WHEREAS, the City of Louisville, City of Lafayette, City and County of Broomfield and <br /> County of Boulder are parties to the Southeast Boulder County, South 96th Street, Dillon Road <br /> and US 287 Area Comprehensive Development Plan Intergovernmental Agreement, dated <br /> February 18, 1999, as previously amended (hereinafter the "Plan" or "IGA and <br /> WHEREAS, the Parties entered into the Plan to plan for and regulate the use of the lands <br /> within the Plan Area through joint adoption of a mutually binding and enforceable <br /> comprehensive development plan; and <br /> WHEREAS, there has been proposed an amendment to the IGA entitled the "Campus <br /> Drive Amendment to Southeast :Boulder County, South 96` Street, Dillon Road and US 287 Area <br /> Comprehensive Development Plan Intergovernmental Agreement," (hereinafter the "Amendment <br /> a copy of which is attached hereto; and <br /> WHEREAS, Section 4.16 of Exhibit A (Text Portion) of the IGA designates certain <br /> parcels totaling approximately 78 acres in unincorporated Boulder County as Rural Preservation <br /> Area with future use limited to agriculture and low density residential development; and <br /> WHEREAS, ConocoPhillips Company, a Delaware corporation, the owner of some of <br /> the above mentioned parcels as specified in the Amendment, desires to annex to the City of <br /> Louisville certain of said parcels, to incorporate portions thereof annexed into Louisville into its <br /> overall plan for redevelopment of the former StorageTek campus; and <br /> WHEREAS, in view thereof, the City Council has determined that it is appropriate to <br /> amend the Plan to accommodate annexation of certain parcels and to allow certain right -of -way <br /> uses addressing potential use of the parcels for right -of -way uses, agriculture, and low density <br /> residential development at residential densities lower than currently contemplated under the Plan; <br /> and <br /> WHEREAS, the City is authorized to execute the proposed Amendment pursuant to law, <br /> including without limitation C.R.S. 29 -20 -101 et seq., which authorizes the parties to the IGA to <br /> cooperate and contract with each other for the purpose of planning and regulating the development <br /> of land by means of a comprehensive development plan; and <br /> WHEREAS, pursuant to C.R.S. 29 -20 -105, the City Council has held a public hearing on <br /> the proposed Amendment and have given notice of such hearing by publication and mailing; and <br /> WHEREAS, the City Council by this Resolution desires to approve the Amendment and <br /> authorize its execution; <br />
