Local Licensing Authority Minutes May 24, 2010 Page 3 of 5 Rommelfanger moved the Authority adopt the Findings, Conclusion and Order as amended by the previous motion and for the violation of Louisville Municipal Code 9.22.050. Carlson seconded. All in favor. Carlson moved the Authority find the petition to pay a fine in lieu of suspension is proper includes the information required by Louisville Municipal Code 5.08.140 and the petition, if granted, will not impair the public welfare and morals, that the back -up information regarding the books and records of the licensee are sufficient to determine the amount and the licensee has not had the license suspended, revoked or stayed during the two -year period immediately preceding the consideration of this petition. Based on these findings Carlson moved the Authority accept the petition to accept payment of a fine -in -lieu of $555.37 and if paid the suspension would be stayed. Rommelfanger seconded. All in favor. B. Findings and Order Show Cause Hearing Village Square B "O" B d /b /a Beef "0" Brady's Hotel and Restaurant Liquor License 585 E. South Boulder Road 3/11/10 Incident Attorney Light stated this consideration would be similar to the previous item. Carlson moved the Authority approve Findings, Conclusion and Order amending language to paragraph 3 of the Conclusion and Order by adding "provided however that if the Licensee is not in operation on May 29, 30, and 31, 2010, the suspension shall be served on three days as determined by mutual agreement of the Licensee and Authority secretary, but in no event later than December 31, 2010 Rommelfanger seconded. Carlson seconded. All in favor.
