The pipeline would be installed <br />approximately four feet below the surface of the Adler Fingru property from the subdivision <br />on the west to Coal Creek on the east, so that there would be no permanent surface <br />disturbance to the open space land. The permanent easement across the Adler Fingru Open <br />Space would be 50 feet wide by 100 feet long. According to Lafayette's representative, Brad <br />Dallam, the new pipeline will provide needed service to the subdivision to the west and will <br />relieve stormwater that collects within the subdivision. The pipeline itself is 6 inches in <br />diameter. <br />Boulder County jointly owns the Adler Fingru Open Space with Lafayette and Louisville. <br />The reciprocal conservation easements that each entity granted to the other entities over its <br />ownership interest in the property allow for the installation of drainage facilities for the <br />purpose of providing water drainage through the property. <br />Terms <br />Boulder County owns a 50% interest in the Adler Fingru property, Lafayette a 25% interest <br />and Louisville a 25% interest. Lafayette has agreed to pay the County $1,250.00 and <br />Louisville $625.00 for the permanent easement in proportion to the property ownership. <br />Public Process <br />Because the Adler Fingru property was purchased with open space sales tax funds, the <br />conveyance of the permanent easement is subject to the requirements for disposition of an <br />interest in open space acquired with sales tax revenues. Notice will be published in the <br />official newspaper of the County and of each city and incorporated town within the County at <br />least 10 days prior to the public hearing with the Board of County Commissioners, which is <br />scheduled for December 2, 2010. If the permanent easement is approved by the <br />Commissioners at the public hearing, there will be a mandatory 60 -day waiting period prior <br />to the conveyance of the easement.
