My client <br />would like to add a small, 65 square foot addition to the south side of their <br />house, and tie the roof into the existing architecture. The existing roofs are 4:12 <br />pitch roofs, and are non conforming according to the Old Town Overlay. We feel <br />that a modest sized addition should be able to tie into the existing roof architec- <br />turally without having to comply with the Old Town Overlay. Having to comply <br />would force us to design a 6:12 pitch roof or greater that ties into the existing <br />4:12 pitch roof, thus creating a difficult and aesthetically challenged roof layout. <br />Below are our responses to the variance criteria: <br />DAJ DESIGN <br />1. That there are unique physical circumstances or conditions such as <br />irregularity, narrowness or shallowness of lot, or exceptional topog- <br />raphical or other physical conditions peculiar to the affected property; <br />The unique physical characteristic is that the entire existing roof of the house <br />is non conforming with a consistent roof pitch of 4:12. Using the Old Town <br />Overlay to design the small addition forces us to design a roof that is not in <br />keeping architecturally with the house. <br />2. That the unusual circumstances or conditions do not exist throughout <br />the neighborhood or district in which the property is located; <br />Many of the houses in the neighborhood do not have entirely non- <br />conforming roofs, however a few of the houses on this block do have entirely <br />non conforming roofs. <br />3. That because of such physical circumstances or conditions,the prop- <br />erty cannot reasonably be developed in conformity with the provisions <br />of this title (Louisville zoning code); <br />The house being viewed by Planning as an entirely non conforming roof cre- <br />ates unreasonable expectations on any design trying comply with the zoning <br />code and complete a small addition. It forces the introduction of a new de- <br />sign element through a steeper roof pitch that does not conform architectur- <br />ally with the existing roof. <br />PAGE 1 <br />
