NOTICE OF PUBLIC HEARING <br />ORDINANCE No. 1874, SERIES 2024 <br />NOTICE IS HEREBY GIVEN that at a regular meeting of the City <br />Council of the City of Louisville, Colorado, to be held on June 4, 2024 <br />at the hour of 5:00 p.m., at Louisville City Hall, 749 Main Street, <br />Louisville, Colorado 80027 or in an electronic meeting, the City <br />Council will hold a Public Hearing on the final passage a MUNICIPAL of a proposed 1 ORDINANCE ENDING EXPANDING <br />I <br />CODE CHAPTER 1556 FOR THE PURPOSE OF EXPANDING THE ROLE <br />OF THE BUILDING CODE BOARD OF APPEALS TO REVIEW AND MAKE <br />n RECOMMENDATIONS TO THE CITY COUNCIL ON BUILDING CODE <br />ADOPT <br />1 Published in the Daily Camera on May 26, 2024 with full ordinance. <br />Full copies available in the City Clerk's Office, 749 Main Street, <br />Louisville CO 80027. <br />ORDINANCE NO. 1874 <br />SERIES 2024 <br />AN ORDINANCE AMENDING LOUISVILLE MUNICIPAL CODE CHAPTER <br />1556 FOR THE PURPOSE OF EXPANDING THE ROLE OF THE BUILD- <br />ING CODE BOARD OF APPEALS TO REVIEW AND MAKE RECOMMEW <br />DATIONS TO THE CITY COUNCIL ON BUILDING CODE ADOPTIONS <br />WHEREAS, the City Council has adopted from time -to -time cer- <br />tain building and construction standards; and <br />WHEREAS, It is deemed to be in the interest of the public <br />health, safety and general welfare to adopt by reference certain <br />building codes with amendments as deemed appropriate; and <br />WHEREAS, the City Council desires to have the Building Code <br />Board of Appeals act in a formal advisory role to the city Council <br />prior to consideration of adoption of any building code and amend- <br />ments thereto; and <br />WHEREAS, the City Council, after proper notice as required by <br />law, has held a public hearing on this ordinance providing for <br />amendments to said codes; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br />THE CITY OF LOUISVILLE, COLORADO: <br />Section I. Louisville Municipal Code Chapter 15.56 concerning <br />authority of the Building Code Board of Appeals, is hereby amended <br />as follows (deleted text in strlkethrougb and new text underlined): <br />See.1556A10. - Created; membership; rules and authority. <br />A. There is hereby created the building code board of <br />appeals ("board"). The purpose of the board Is to <br />hear and decide appeals of orders, decisions or <br />determinations made by the building official <br />relative to the application and Interpretation of the <br />bulldingg codes, and amendments thereto, as <br />adooted from time to time by reference within this <br />ooara snail consist of Live members wno are <br />qualified by experience and training to pass on <br />matters pertaining to building construction and who <br />are not employees of the city. Residence within the <br />city limits of the city shall not be a requirement or <br />building oniclal Shan be an ex OffIC10 member Ot <br />and shall act as secretary to the board but shall <br />have no vote on any matter before the board. <br />Section 2. If any portion of this ordinance is held to be invalid <br />for any reason, such decision shall not affect the validity of the re- <br />malning portions of this ordinance. The City Council hereby de- <br />clares that It would have passed this ordinance and each part here- <br />of Irrespective of the fact that any one part be declared invalid. <br />Section 3. The repeal or modification of any rovision of the <br />Municipal Code of the City of Louisville by this ordnance shall not <br />release, extinguish, alter, modify or change In whole or In part anY <br />penalty, forfeiture, or liability, either civil or criminal, which shall <br />have been incurred under such provislon, and each provision shall <br />be treated and held as still remaining in force for the purpose of <br />sustaining any and all proper actions, suits, proceedings, and pros- <br />ecutions for the enforcement of the penalty, forfeiture, or liability, <br />as well as for the purpose of sustaining any judgment, decree, or <br />order which can or may be rendered, entered, or made In such ac- <br />tions, suits, proceedings, or prosecutions. <br />Section.4..
