RESOLUTION NO. 41 <br />SERIES 1999 <br /> <br /> A RESOLUTION APPROVING <br />A FINAL SUBDIVISION REPLAT AND FINAL PUD DEVELOPMENT PLAN <br />FOR LOTS 2 THROUGH 6, BLOCK 7 - THE BUSINESS CENTER AT CTC <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a Final Subdivision Replat and a Final PUD Development Plan authorizing three <br />freestanding 'flex' building sites for a total square footage of 168,479 SF; and <br /> <br /> WHEREAS, all materials related to the Final Subdivision Replat and Final PUD <br />Development Plan have been reviewed by City Staff and the Planning Commission and found, with <br />conditions, to be in compliance with the Louisville zoning ordinances, subdivision regulations, <br />related policies and previous approvals; and <br /> <br /> WHEREAS, after a properly noticed public hearing concerning said Final Subdivision <br />Replat and Final PUD Development Plan, the Planning Commission recommended approval to the <br />City Council, with conditions; and <br /> <br /> WHEREAS, the City Council finds that where all Commission conditions have been <br />addressed as part of the revised PUD submittal, that said Final PUD Development Plan should be <br />approved, with the following conditions: <br /> <br />1. A cross access easement shall be recorded to authorize the multiple shared access points <br /> between the three lots prior to the issuance of the first building permit. <br /> <br />That the applicant shall make formal application for a text amendment of Ordinance 501, <br />Series 1976 to remove the current geologic hazard area. Review by the Planning <br />Commission and approval by the City Council shall be granted prior to the issuance ora <br />grading or building permit for Building 'A '. <br /> <br />3. Several easements, which currently conflict with building locations, shall be vacated by a <br /> separate ordinance upon authorization of the City Council. <br /> <br />4. That the monument sign on the cul-de-sac is not authorized and shall be removed from the <br /> PUD plans. <br /> <br />That the use of the property shall be subject to the final geologic hazard area designation <br />under the proposed Ordinance No. 1307, Series 1999. In the event the final designation <br />prohibits uses of the designated area that are set forth in this PUD, then the applicant shall <br />amend the PUD to make its uses compatible with the designation. <br /> <br /> NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Louisville, <br />Colorado does hereby approve a Final Subdivision Replat and a Final PUD Development Plan for <br />Lots 2 through 6, Block 7 The Business Center at CTC, subject to the above conditions. <br /> <br /> <br />
