RESOLUTION NO. 39 <br /> SERIES 1999 <br /> <br />A RESOLUTION APPROVING A FINAL PUD DEVELOPMENT PLAN FOR THE <br />VILLAGE SHOPS AT COLONY SQUARE, LOTS 1 THROUGH 4 AND THE WEST <br />ONE-HALF OF THE VACATED 80TM STREET RIGHT-OF-WAY, <br /> COLONY SQUARE SUBDIVISION <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a Final PUD Development Plan for the Village Shops at Colony Square, Lots 1 <br />through 4, Colony Square Subdivision, and adjacent portions of the vacated west one-half of the <br />80~ Street right-of-way; and <br /> <br /> WHEREAS, all materials related to the Final PUD Development Plan have been reviewed <br />by City Staff and the Planning Commission and found, with conditions, to be in compliance with <br />the Louisville zoning ordinances, subdivision regulations, related policies and previous approvals; <br />and <br /> <br /> WHEREAS, after a duly noticed public hearing concerning said Final PUD Development <br />Plan, the Planning Commission recommended approval to the City Council, with conditions; and <br /> <br /> WHEREAS, the applicant has revised the application in response to the Planning <br />Commission's conditions and City Council finds that said Final PUD Development Plan should <br />be approved, with the following conditions: <br /> <br />o <br /> <br />That the applicant provide documentation acceptable to the City Attorney indicating that <br />Koelbel & Company has assigned to owner rights to use City open space (Parcel S-3)for <br />stormwater detention prior to recording of the final PUD. <br /> <br />That the owner and developer secure a revocable license agreement with the City to use the <br />City's portion of the vacated 80th Street right-of-way for stormwater detention purposes, and <br />that the development agreement contain provisions for maintenance of facilities and <br />landscaping installed on City open space (Parcel S-3), and for coordination of development <br />activities in the City open space; <br /> <br />That the applicant obtain consents from interested and affected owners for the redesign of the <br />access drives and any reconstruction of other common public and private improvements that <br />are shared between all Colony Square lots and other property owners; <br /> <br />That additional trees be provided on the easterly portion of the Colony Square property to <br />comply with the CDDSG; <br /> <br />That the applicant must submit a separate sign package to Planning Commission and City <br />Council for review and approval under the PUD Ordinance. No signage is approved by this <br /> <br /> <br />
