Section 2. Amount of Exemption. The amount of the use tax exemp- <br />tion provided by this ordinance shall equal the lull amount of the <br />City use tax due for the construction and building materials. <br />Section 3. Refunds of City Use Taxes. City staff Is authorized <br />and directed to Issue refunds of City use takes paid In connection <br />with building permits issued prior to the effective date of this ordi- <br />nance, and which permits meet the requirements for exemption set <br />forth in Section I of this ordinance. The amount of such refunds <br />shall he determined as set forth in Section 2 of this ordinance. <br />Section 4. If any portion of this ordinance is held to be invalid for <br />any reason, such decision shall not affect the validity of the remain- <br />ing portions of this ordinance. The City Council hereby declares <br />that it would have passed this ordinance and each part hereof irre- <br />spective of the fact that any one part be declared invalid. <br />Section 5. The repeal or modification of arty provision of the <br />Municipal Cede of the City of Louisville by this ordinance shall not <br />release, extinguish, alter, modify, or change in whole or in part any <br />penalty, forfeiture, or liability either civil or criminal, which shall <br />have been incurred under such provision, and each provision shall <br />be treated and held as still remaining in force for the purpose of <br />sustaining arty and all proper actions, suits, proceedings, and pros- <br />ecutions for the enforcement of the penalty, forfeiture, or liability, <br />as well as Inc the purpose of sustaining any judgment, decree, or <br />order which can or may be rendered. entered, or made In such ac- <br />tions, suits, proceedings or prosecutions. <br />SectionB. All other ordinances or portions thereof inconsis- <br />tent or conflicting with this ordinance or any portion hereof are <br />hereby repealed to the extent of such inconsistency or conflict. <br />Section 7. The City Council herewith finds, determines and declares <br />that this ordinance is genuinely and urgently necessary for the im- <br />mediate preservation of the public health, safety, and welfare due <br />to the impacts of the Marshall Fire set forth herein. <br />INTRODUCED.
