Section 2. Amount of Exemption. The amount of the use tax exemp- tion provided by this ordinance shall equal the lull amount of the City use tax due for the construction and building materials. Section 3. Refunds of City Use Taxes. City staff Is authorized and directed to Issue refunds of City use takes paid In connection with building permits issued prior to the effective date of this ordi- nance, and which permits meet the requirements for exemption set forth in Section I of this ordinance. The amount of such refunds shall he determined as set forth in Section 2 of this ordinance. Section 4. If any portion of this ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remain- ing portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part hereof irre- spective of the fact that any one part be declared invalid. Section 5. The repeal or modification of arty provision of the Municipal Cede of the City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole or in part any penalty, forfeiture, or liability either civil or criminal, which shall have been incurred under such provision, and each provision shall be treated and held as still remaining in force for the purpose of sustaining arty and all proper actions, suits, proceedings, and pros- ecutions for the enforcement of the penalty, forfeiture, or liability, as well as Inc the purpose of sustaining any judgment, decree, or order which can or may be rendered. entered, or made In such ac- tions, suits, proceedings or prosecutions. The City Council herewith finds, determines and declares that this ordinance is genuinely and urgently necessary for the im- mediate preservation of the public health, safety, and welfare due to the impacts of the Marshall Fire set forth herein.
