RESOLUTION NO. 35 <br />SERIES 1999 <br /> <br />A RESOLUTION APPROVING A FINAL SUBDIVISION REPLAT <br />AND A FINAL PUD DEVELOPMENT PLAN <br /> FOR LOTS 2, 3, 4 AND 5, BLOCK 2, <br /> THE BUSINESS CENTER AT CTC, REPLAT B <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a final subdivision replat and final PUD development plan for Lots 2, 3, 4 and 5, <br />Block 2, The Business Center at CTC, Replat B; and <br /> <br /> WHEREAS, all materials related to the subdivision replat and PUD development plan <br />have been reviewed by City Staff and the Planning Commission and found, with conditions, to be <br />in compliance with the Louisville zoning ordinances, subdivision regulations, related policies and <br />previous approvals; and <br /> <br /> WHEREAS, after a properly advertised public hearing concerning said subdivision replat <br />and final PUD development plan, the Planning Commission recommended approval to the City <br />Council, with conditions; and <br /> <br /> WHEREAS, the applicant has revised the application in response to the Planning <br />Commission's conditions and City Council finds that said subdivision replat and final PUD <br />development plan should be approved, with the following conditions: <br /> <br />That all existing easements no longer needed on this plat are vacated by separate easement <br />vacation ordinance, after recordation of the subdivision replat and prior to issuance of any <br />building permits on these lots; <br /> <br />That the City Staff shall review and approve the proposed cross access easement prior to <br />recordation with Boulder County, and prior to issuance of any building permits; <br /> <br />That the City shall review and approve the declaration regarding maintenance of Outlot M <br />prior to recordation with Boulder County, and prior to issuance of any building permits; <br /> <br />That two additional utility easement stub outs are provided to the vacant properties to the <br />east and south, to preserve the opportunity to provide water service to those lots from the <br />public water line running through this site; <br /> <br />That an additional street tree is provided at the entry at the northeast corner of the <br />development. <br /> <br />o <br /> <br />That at either side of each of the main entries, the bottom section of windows be removed <br />to better define the main entries, and to break the long continuous window pattern; and <br /> <br /> <br />
