COUNCIL COMMUNICATION TO: MAYOR AND CITY COUNCIL FROM: MALCOLM FLEMING, CITY MANAGER DATE: JANUARY 10, 2011 SUBJECT: CONSIDERATION OF INCREASE IN SALARY FOR MUNICIPAL JUDGE AND DEPUTY MUNICIPAL JUDGE ORIGINATING DEPARTMENT: CITY MANAGER’S OFFICE SUMMARY: In 2010 the judge requested an increase in salary, based on market pay. Staff prepared the attached spreadsheet related to pay for Municipal Judges, Deputy/Associate Municipal Judges and Prosecuting Attorneys. Based on the data, staff recommended increasing the Judge’s salary from $100 an hour to $125 resulting in a monthly salary of $2,000 (four, 4-hour sessions per month) and increasing the Deputy Judge’s salary from $300 per 4 hour court session to $325. Staff did not recommend a change to the Prosecuting Attorney salary as that position was recently appointed in mid-2010. Please find attached the Ordinance related to the Municipal Judge’s Salary increase as well as the Resolution related to the increase for the Deputy Municipal Judge. Both issues will be before City Council for approval on January 18, 2011. FISCAL IMPACT: For the Municipal Judge’s Salary, an increase of $400 a month or $4800 annually and for the Deputy Judge an addition of $25 per 4-hour court session. The Municipal Court 2011 budget was increased by a fraction over $4800 a month to account for the increase to the Municipal Judge’s salary and the increase per session for the Deputy Municipal Judge. RECOMMENDATION: Recommend the increase in salary for both the Municipal Judge and Deputy Municipal Judge in 2011.
