Pritchard stated the landscaping for the original site is what he considers to be sub-standard. Does the applicant then pay a fee-in-lieu for not meeting the landscape requirements? McCartney stated no, a fee-in-lieu is only paid for parking. Brauneis asked if a fueling station relies on its neighborhood. McCartney stated they do not but since it will be the only gas station on the east side of Hwy 42 the neighborhood is an important element. Brauneis asked if vending machines would be installed. He also asked for additional information regarding the photometric light details for the site. McCartney stated the applicant should answer the question about vending machines and the lighting details. Sheets asked if the underground storage tanks had any regulations. McCartney stated there are state requirements and additional building code requirements might apply. Applicant Presentation: Carl Schmidtlein, Galloway and Associates, representing King Soopers, answered the questions previously posed by the Commissioners: Vending machines will be owned and operated by King Soopers and will  be located up against the kiosk for monitoring by the employee. The photometric reading for under the canopy is 17 foot candles. The  recessed lighting is downcast thus there is little to no light pollution. The underground storage tanks meet or exceed all federal, state and local  building codes. They are a double walled tanked. Schmidtlein asked if the Commissioners had other questions. Lipton asked about the hours of operation. Schmidtlein stated the fueling station would be available 24 hours a day for those individuals using credit cards. The kiosk will be manned from 6:00 AM to 10:00 PM. There are also security cameras which are monitored from within the King Soopers building. Pritchard requested additional information on the lighting. Schmidtlein reviewed the three classes of available lighting: rural, urban (not dense) and urban dense. The proposed fixtures comply with the urban dense which is at the lower end of the lighting scale. If the foot candles drop below 17 then the store has a safety concern for the fueling site. Brauneis asked if the lighting would be more intense along Plaza Drive.
