Planning Commission <br />Meeting Minutes <br />November 18, 2010 <br />Page 6 of 10 <br /> <br />McCartney stated the distance is approximately 600’ to the western side of Hecla <br />Street. <br />Sheets asked if there will be a fence. <br />McCartney stated the applicant should answer her question. <br />Brauneis stated a concern with the noise factor and the close proximity to offices. <br />McCartney discussed other locations in the City where kennels are permitted in a <br />use by right by the type of zoning. <br />Russell asked why a kennel would be a use by right in a commercial zone while <br />in an industrial zone it is a SRU. <br />McCartney stated he was not working in Louisville when the use by right was <br />established for the specific zone district so he could not answer his question. <br />Applicant Presentation: <br />Tim Nissen, owner of The Divine Canine, 1141 South St. stated his wife, Sarah, <br />could not attend this evening. He stated he did not have a prepared presentation <br />but would answer any questions the Commissioners might have. <br />Commission Questions of Staff and Applicant: <br />Lipton asked if there is a fire suppression system in the building. <br />Nissen stated the Department of Agriculture does not require a sprinkler system <br />but the business does have smoke and carbon monoxide detectors installed. The <br />same practice will be followed at the new location. <br />The other Commissioners stated they had no additional questions of the <br />applicant. <br />Members of the Public: <br />Rick Brew, Takoda Development, adjacent property owner to the proposed dog <br />daycare, thanked staff and the applicant for the work they have done. He stated <br />the proposed limitation of the 370’ distance is acceptable to Takoda <br />Development. He stated the proposed limitation will provide an approximate <br />separation of 600’ with the proposed townhomes at Takoda. <br />Russell stated he had an additional question for the applicant. Are there any <br />noise abatement issues for the change of site? <br />Nissen stated they have done no additional noise abatement to the current site <br />and they had no plans to modify the proposed site. He continued with a <br />discussion regarding the proposed uses for the site: kennels, outside play groups <br />of dogs, fencing, retail, training and grooming. <br />Rob Lathrop, 601 Johnson St., owner of the subject property spoke about the <br />business owners and how he has been impressed them and their dedication to <br />making the business a viable business in Louisville. <br />Staff and Applicant Summary and Recommendation: <br />None heard. <br />Public Hearing Closed Commission Comments: <br /> <br />
