As a result of this modification to the location and compatibility criteria, only one
additional medical marijuana business, not two as previously presented, will be allowed
within the City of Louisville. The two existing facilities would be grandfathered and
permitted to continue in the current locations. The following graphic illustrates the areas
of the City eligible for a medical marijuana business under the proposed regulations.
 tisf g
looporie l III r i
S
` II r{
emlwnee
um
WICK
65 a
Planning Commission
Staff Report
February 10, 2011
Darr of LDU!SV LL
G I S
DEPARTMENT
Medical Marijuana
Setback
Commercial Business Districts
Outside 1320' Buffer
1).011,11 kx. Mom, IH,Inguil
During the January 13 public hearing, Planning Commission also inquired about the
possibility of creating a restrictive buffer around residential areas within the City. In
reviewing the locations of the eligible Commercial Business (C -B) Zoned Districts
throughout the City, staff has concluded any buffer around residential areas would
effectively eliminate the possibility of medical marijuana operations in the City and would
be in conflict with City Council's November 16, 2010 direction not to outlaw medical
marijuana businesses, but to regulate them.
As a result, the following section of the Title 17 Ordinance presented at the January 13,
2011 Public Hearing regarding medical marijuana has been revised, changes are
highlighted in bold and underlined text:
Section 5. Chapter 17.16 of the Louisville Municipal Code is hereby amended by the
addition of a new Section 17.16.235, to read as follows:
2
