Section 17.16.040 of the LMC will also need to be amended to reflect the state's new <br />definitions. Recommended changes include those documented below (words modified <br />and added are underlined in BOLD): <br />17.16.040 Home Occupations. <br />H. The following uses, because of their tendency to go beyond the limits <br />permitted for home occupations and thereby impair the use and value of the <br />residential area, shall not be permitted as home occupations: auto repair or <br />motorized implement repair; dance, music or other types of instruction (if more <br />than four students being instructed at one time); dental offices; medical offices; <br />medical marijuana centers; medical marijuana — infused products <br />manufacturer; medical marijuana optional premises cultivation operation; <br />the painting of vehicles, trailers or boats; private schools with organized classes; <br />radio and television repair; barber and /or beauty shop; welding shops; nursing <br />homes; massage therapy by a massage therapist; sexually oriented businesses; <br />and, irrespective of whether the use may be categorized as a sexually oriented <br />business, any retail or wholesale sales to consumers upon the premises of any <br />types of materials specified in this title which describe or depict specified sexual <br />activities or specified anatomical areas. <br />AMENDMENTS TO TITLE 5 — BUSINESS LICENSES AND REGULATIONS <br />Planning Commission <br />Staff Report <br />February 10, 2011 <br />Ordinance # , Series 2011 amends Title 5 of the LMC to establish: a comprehensive <br />licensing ordinance for all medical marijuana centers and infused products <br />manufacturers, location requirements for medical marijuana centers (MMC) and <br />requirements governing the operation of these facilities. The regulations also address <br />the cultivation of marijuana by patients and primary caregivers who serve no more than <br />one patient and do not constitute an MMC. The draft ordinance is attached to the end of <br />this staff report. The City of Fort Collins Medical Marijuana Ordinance was the primary <br />template for the recommended ordinance. <br />Location, Proximity, and Size <br />In addition to the permitted uses and zoning designations identified in Title 17, staff is <br />recommending the following be included as part of the licensing regulations: <br />1. Allowed only in the Commercial Business (C -B) zone district <br />2. A 1,320' school and residential child care buffer requirement, <br />3. A maximum allowance of no more than two medical marijuana businesses within <br />a 1,320' radius. <br />4. A maximum leasable square feet allowance of 1,800 SF. <br />5. Not allowed on City property <br />6. Cannot operate as an outdoor vendor <br />Distances described above shall be computed by direct measurement in a straight line <br />from the nearest property line to the nearest portion of the building or unit in which the <br />medical marijuana center or medical marijuana- infused product manufacturer is located. <br />8 <br />
