Redtail Ridge Metropolitan District Nos. 1, 2 and 4 should be approved by the City <br />Council, subject to certain conditions set forth below, in accordance with Section 32-1- <br />204.5(1)(c), C.R.S. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. That the City Council, as the governing body of the City of Louisville, <br />Colorado, does hereby determine, based on representations by and on behalf of Redtail <br />Ridge Portfolio, LLC, a Delaware limited liability company (the "Developer") and Redtail <br />Ridge Metropolitan District and Redtail Ridge Metropolitan District Nos. 1, 2 and 4 <br />(collectively, the "Districts"), that all of the requirements of Title 32, Article 1, Part 2, <br />C.R.S., as amended, relating to the filing of Amended and Restated Service Plans for <br />the Redtail Ridge Metropolitan District and Redtail Ridge Metropolitan District Nos. 1, 2 <br />and 4 have been fulfilled and that notice of the hearing was given in the time and <br />manner required by law. <br />Section 2. That, based on representations by and on behalf of the Developer <br />and the Districts, the City Council of the City of Louisville, Colorado, has jurisdiction <br />over the subject matter of this request for approval of an Amended and Restated <br />Service Plan pursuant to Title 32, Article 1, part 2, C.R.S., as amended. <br />Section 3. That, pursuant to Section 32-1-204.5, C.R.S., Section 32-1-202(2), <br />C.R.S., and Section 32-1-203(2), C.R.S., the City Council of the City of Louisville, <br />Colorado, does hereby find and determine, based on the Amended and Restated <br />Service Plans and other evidence presented at the public hearing, that: <br />(a) There is sufficient existing and projected need for organized service <br />in the area to be serviced by the Districts; <br />(b) The existing service in the area to be served by the Districts is <br />inadequate for present and projected needs; <br />(c) The Districts are capable of providing economical and sufficient <br />service to the area within their proposed boundaries; <br />(d) The area included in the Districts has, or will have, the financial <br />ability to discharge the proposed indebtedness of the Districts, as <br />set forth in the Amended and Restated Service Plans, on a <br />reasonable basis; and <br />(e) Approval of the Amended and Restated Service Plans for the <br />Districts will be in the best interests of the area proposed to be <br />served. <br />2 <br />
