Redtail Ridge Metropolitan District Nos. 1, 2 and 4 should be approved by the City Council, subject to certain conditions set forth below, in accordance with Section 32-1- 204.5(1)(c), C.R.S. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. That the City Council, as the governing body of the City of Louisville, Colorado, does hereby determine, based on representations by and on behalf of Redtail Ridge Portfolio, LLC, a Delaware limited liability company (the "Developer") and Redtail Ridge Metropolitan District and Redtail Ridge Metropolitan District Nos. 1, 2 and 4 (collectively, the "Districts"), that all of the requirements of Title 32, Article 1, Part 2, C.R.S., as amended, relating to the filing of Amended and Restated Service Plans for the Redtail Ridge Metropolitan District and Redtail Ridge Metropolitan District Nos. 1, 2 and 4 have been fulfilled and that notice of the hearing was given in the time and manner required by law. Section 2. That, based on representations by and on behalf of the Developer and the Districts, the City Council of the City of Louisville, Colorado, has jurisdiction over the subject matter of this request for approval of an Amended and Restated Service Plan pursuant to Title 32, Article 1, part 2, C.R.S., as amended. Section 3. That, pursuant to Section 32-1-204.5, C.R.S., Section 32-1-202(2), C.R.S., and Section 32-1-203(2), C.R.S., the City Council of the City of Louisville, Colorado, does hereby find and determine, based on the Amended and Restated Service Plans and other evidence presented at the public hearing, that: (a) There is sufficient existing and projected need for organized service in the area to be serviced by the Districts; (b) The existing service in the area to be served by the Districts is inadequate for present and projected needs; (c) The Districts are capable of providing economical and sufficient service to the area within their proposed boundaries; (d) The area included in the Districts has, or will have, the financial ability to discharge the proposed indebtedness of the Districts, as set forth in the Amended and Restated Service Plans, on a reasonable basis; and (e) Approval of the Amended and Restated Service Plans for the Districts will be in the best interests of the area proposed to be served. 2
